Important brain tumour websites Brain Tumours \| 1 BRAIN TUMOURS 1. Knowing brain tumours Brain tumours are quite diverse affecting all age groups. These tumours pose several challenges from treatment perspective including rehabilitation and support services of not only the affected person but also the care giver. However due to the improvement in neurosurgical, radiotherapy techniques and development of newer chemotherapeutic and biological agents, the outlook of these tumours have improved over the last decade period of time. Moreover, while long term survivors of brain tumours still have considerable issues in several aspects of their activities of daily living and quality of life, there are many of them, who are not only enjoying an excellent quality of life but are also integrating into the main stream and leading a good social life. Worldwide Incidence of brain tumours Brain tumours, though uncommon are not a rare entity. Globally brain tumours account for less than 2% of all cancers (approximately 175000 cases per year worldwide). Its annual incidence is 3.7 per 100,000 for men and 2.6 per 100,000 for women. How common is brain tumour in India? The incidence of primary brain tumour in India ranges from 2.5 to 4.1 per 100,000 population for males and 1.4 to 2.6 per 100,000 population for females based on the Indian Council of Medical Research (ICMR) database. It represents < 1% of new cancer cases detected every year in the country. However, there has been a steady increase in the incidence of primary brain tumours over the last decade or so primarily due to higher detection rates, better awareness among individuals and from widespread availability of excellent diagnostic imaging in India. In children, brain tumours account for approximately 35% of all types of tumours and are the second most common cancers second only to leukemias. Data compiled from multiple institutes of India has shown that most common brain tumour in children are astrocytomas (34.7%), followed by medulloblastoma and 2 \| JASCAP / BTF supratentorial primitive neuro-ectodermal tumours (22.4%), craniopharyngiomas (10.2%) and ependymal tumours (9.8%). The most common astrocytic tumour was pilocytic astrocytoma. These tumours are quite diverse in nature ranging from benign to malignant tumours. Benign (Non cancerous) brain tumours do not contain cancer cells: Majority of the benign tumours can be removed, and they seldom grow back. Cells from benign tumours do not invade tissues around them or spread to other parts of the body. However, benign tumours can press on critical areas of the brain and cause serious and life threatening neurological problems. Malignant (cancerous) brain tumours contain cancer cells: They are likely to grow rapidly and crowd or invade the surrounding healthy brain tissue. Very rarely, cancer cells may break away from a primary brain tumour and spread to other parts of the brain, to the spinal cord, or very occasionally even to other parts of the body.. Malignant brain tumour is generally more serious and often is life threatening. These tumours affect all age groups right from the very young to the very old. Management of these tumours poses several challenges right from treatment to ancillary care including rehabilitation and support services. In some patients, a low grade tumour will develop into a high grade malignant tumour. It is called malignant transformation or progression to malignancy. Primary and secondary brain tumours A primary brain tumour is a solid tumour, defined as an abnormal growth of cells within the brain or the central spinal canal. This abnormal and uncontrolled cell division usually occurs in the brain, in blood vessels, in the cranial nerves, in the brain envelopes (meninges), skull bone, pituitary gland, or pineal gland. When cancer spreads from its original place to another part of the body, the new tumour has the same kind of abnormal cells as the primary tumour. Cancer that spreads to the brain from another part of the body is different from a primary brain tumour. When Brain Tumours \| 3 cancer cells spread to the brain from another organ (such as the lung or breast) doctors may call the tumour in the brain a secondary tumour or brain metastasis. In India, primary brain tumours are far more common than brain metastasis which is in contrast to the western countries where metastatic brain tumours are more common. Risk factors & Possible causes of brain tumours There are no known causes of brain tumours. Unlike some of the tumours in the body it is not caused by any infection or infectious agent. Research in the area of causation of brain tumours is still ongoing. Brain tumours are not contagious and cannot be transmitted from one person to another. Age Brain tumours can occur at any age. Certain brain tumours like gliomas usually occur in middle age and elderly individuals while certain tumours occur during childhood and adolescence. Exposure to medical radiation Exposure to radiation is the only definite risk factor for development of second cancers especially brain tumours. People who are exposed to radiotherapy, frequent CT scans or X-rays of the head are at higher risk of developing brain tumours like meningiomas and to a lesser extent, malignant gliomas Although medical exposure to radiation is kept as low as possible, X-rays and CT scans are important modalities in diagnosing diseases so that you have the right treatment. Previous cancers Children who have had cancer have a higher risk of developing a brain tumour later in life. For e.g. children who have had leukemia (a type of blood cancer) or Hodgkin or Non-Hodgkin lymphoma (a type of cancer of the lymph nodes) as an adult also have an increased risk of brain tumour. There is some evidence that there is an increased risk of brain tumours in adults who have had other types of cancer for e.g. breast cancer survivors who have been 4 \| JASCAP / BTF treated with chemotherapy may have an increased risk of pituitary adenomas. This increased risk has been postulated due to the treatment for the previous cancer, such as radiotherapy to the head. However, it should be kept in mind that the benefit of treatment for the original cancer far outweighs the risk of brain tumour. Genetic conditions and family history Less than 1% of brain tumours is associated with genetic conditions and occurs in members of a family. People who have one of these rare syndromes have an increased risk of getting a brain tumour. Patients with family history of any of brain tumours need to get themselves properly investigated with relevant investigations. Examples of the syndromes associated with brain tumours are • Neurofibromatosis types 1 & 2 • Tuberous sclerosis • Li Fraumeni Syndrome • Von Hippel Lindau Syndrome • Turner Syndrome • Turcot syndrome • Gorlin Syndrome If you have a parent, brother or a sister diagnosed with a brain tumour, your risk may be slightly higher than other people. Other medical conditions and medicines People with HIV or AIDS have double the risk of being diagnosed with a particular type of brain tumour called lymphoma of the brain which is also called as Primary CNS lymphoma. The HIV patients tend to have this form of brain tumour at a younger age. These is a small risk of women developing brain tumours especially meningiomas. Post menopausal women who are taking hormone replacement therapy (HRT) or younger woman who are taking oral contraceptive pills (OCP) may have slightly increased risk. However, this link needs to be proved by further research studies. Mobile phones Cell phones emit radiofrequency electromagnetic radiation. The Do's Don'ts • Use mobile phones in speaker or hand's free mode or Bluetooth headsets • Use mobiles of low SAR (specific absorption rate) value • Texting instead of talking on the phone • Limit the use of mobile phones as much as possible. Keep your conversations short and sweet. • When you use the phone, try to alternate the side of the face you are using. • Wherever possible Use the landline instead of mobile phone. • Do not keep your mobile phones under your pillow while sleeping. • Avoid using mobile phones whenever there is a weak signal, as that's when it uses more power and so the energy deposition is much more. • Do not press the phone against your head to hear more clearly. • Avoid using the phone when your hair is wet and hold it away if you are wearing a metal spectacle frame, as water and metal are good conductors of radio waves. • Children should limit the use of mobile phones to avoid longer duration of exposure to radio waves, as their bones are thin because of which the absorption rate is higher. Brain Tumours \| 5 amount of radiofrequency electromagnetic radiation a cell phone user is exposed to depend on the technology of the phone, the distance between the phone’s antenna and the user, and the user’s distance from cell phone towers. International Agency for Research on Cancer (IARC) have categorized the radiation emitted from cell phones as category 2B carcinogen which means that there is inadequate evidence of carcinogenicity in humans but sufficient evidence of carcinogenicity in experimental animals. Studies thus far have not shown a consistent link between cell phone use and cancers of the brain, nerves, or other tissues of the head or neck. From the evidence so far we still can’t say that mobile phones pose a problem to health. There has been a concern about them causing brain tumours in particular. But there is no strong evidence that there is any link. More research is needed because cell phone technology and the way people are using cell phones have been changing rapidly. Even though there is no strong evidence suggesting that radiations emitted from cell phones increases the risk of brain cancer, individuals need to be cautious while using cell phones. Do’s and Don’ts of mobile cell phone use 6 \| JASCAP / BTF 2. The brain: its structure & its functions How the brain works The brain is the control centre of the body and mind. It controls the body by sending electrical messages along nerve fibres. The nerve fibres run out of the base of the brain and into the spinal cord. From the spinal cord the nerve fibres spread out to all areas of the body. The spinal cord also communicates messages and sensations from nerves in the body back to the brain. Together, the brain and spinal cord form the central nervous system. A clear fluid circulates around the brain and spinal cord and protects them. It is called cerebrospinal fluid also called CSF. The brain is made of nerve cells called neurons. There are billions of these neurons. Also in the brain are other types of cells that support the neurons. These are called glial cells. There ar many different types of cells in the brain and these can develop into different types of brain tumours. Different areas of the brain control different parts of the body as well as our thoughts, memories and feelings. Brain tumours can develop anywhere in the brain. They can develop from • The cells that make up the brain tissue • The nerves entering or leaving the brain • The coverings of the brain (the meninges) Different symptoms due to brain tumours depend on the part of the brain they are located. So, to understand why brain tumours cause particular symptoms, it helps to know a little about the different structures of the brain. Parts of the brain The main areas of the brain include • The cerebrum (forebrain) • The brain stem • The cerebellum (hindbrain) The cerebrum The cerebrum is the largest part of the brain. It is also called the Brain Tumours \| 7 Figure 1: A simple diagram to illustrate the different cerebral lobes of the brain, brain stem and cerebellum forebrain and is divided into the right and left cerebral hemispheres. They control movement, thinking, memory, emotions, senses and speech. Special MRI scans done during specific tasks (functional MRI) have helped us to understand which areas of the brain relate to particular functions. As the nerve fibres leave the brain, they cross over from one side to the other. This means that the nerves that come from the right side of your brain control the left side of your body. So if you have a brain tumour causing weakness on the left side of your body, the tumour will be in the right side of your brain. Each cerebral hemisphere is divided into 4 areas as illustrated in figure 1 The frontal lobe contains areas that work with speaking, planning, problem solving, starting particular movements, and some aspects of personality and character. Towards the back of the frontal lobe are areas that coordinate movement and also process sensations. 8 \| JASCAP / BTF The temporal lobe is where we process sounds and also where memory is stored. A tumour here can cause strange feelings of having been somewhere or done something before (also called déjà vu). It may also cause abnormal tastes or smells. The parietal lobe controls touch, temperature, pressure and pain sensations. It is where we recognise objects in the world around us and store that knowledge. One area also processes the information when people speak to us. A tumour here can affect speech, reading, writing or the understanding of words. The occipital lobe is the visual centre of the brain and processes what we see, including colour, shape and distance. A brain tumour in this area can cause problems in vision. The brain stem The brain stem controls vital body functions. Blood pressure, swallowing, breathing and heartbeat are all managed by this area of the brain. The brain stem has 3 main parts and are called the pons, and the medulla. The brain stem also includes a small area above the pons called the midbrain. The brain stem connects the cerebral hemispheres and the cerebellum with the spinal cord. All the nerve fibres leaving the brain pass through here to go to the limbs and trunk of the body. The cerebellum The cerebellum is also called the hindbrain. It controls balance and posture. It is also involved with coordination of skilled movements. For example, walking or movement of hands needs a lot of coordination. This is controlled by the cerebellum. Cerebellar tumours can cause loss of balance or difficulty coordinating your movements. The pituitary gland and pineal gland The pituitary gland is a small gland in the middle below the brain. The pituitary gland makes a lot of different hormones. And it controls many different body functions. Pituitary hormones control • Growth Brain Tumours \| 9 • The speed of body processes (your metabolism) • The production of natural steroids in the body • Periods and egg production in women • Sperm production in men • Breast milk production after the birth of a baby The pineal gland is a very small gland deep in the brain. It makes the hormone melatonin. These control sleep patterns. The ventricles Ventricles are spaces inside the brain, filled with the fluid called cerebrospinal fluid or CSF. The ventricles connect with the space in the centre of the spinal cord and with the membranes covering the brain (the meninges). So the fluid can circulate around and through the brain and around the spinal cord. A growing brain tumour can block the circulation of the fluid. The resulting increased pressure inside the skull from fluid buildup is called hydrocephalus and can cause symptoms. With some types of brain tumours cancer cells can spread in the CSF, causing symptoms similar to meningitis - headaches, sickness, and problems with sight and movement. The meninges The skull protects the brain. Inside the skull, and covering the brain, are 3 thin sheets of body tissue. These are called the meninges and they also help to protect the brain. This is illustrated in figure 2 Figure 2: Diagram showing the three coverings of the brain 10 \| JASCAP / BTF Some general signs & symptoms of brain tumours Brain tumours cause symptoms for two reasons. Firstly, because they take up space inside the skull as they grow. Secondly, they can cause specific symptoms due to their position in the brain. • A new seizure in an adult • Gradual loss of movement or sensation in an arm or leg • Unsteadiness or imbalance, especially if it is associated with headache • Drowsiness. • Loss of vision in one or both eyes, especially if the vision loss is more peripheral • Double vision, especially if it is associated with headache • Hearing loss with or without dizziness • Speech difficulty of gradual onset • Nausea or vomiting that is most severe in the morning, confusion and disorientation, and memory loss. • Any abnormal change in behavior r(increasingly irritable) • infertility • Irregular or loss of menstrual cycles in females 3. Specific symptoms based on the location of the brain tumour Position of Tumour Symptoms Frontal Lobe Changes in personality, Swearing or behaving in a way that you normally wouldn’t, (loss of inhibitions) Losing interest in life, (apathy) Difficulty with planning and organizing. Being irritable or aggressive, Weakness in part of the face, or on one side of the body, Difficulty walking, Loss of sense of smell, Problems with your sight or speech. Temporal Lobe Forgetting words, Difficulty finding the correct word, Short term memory loss, Fits associated with strange feelings, smells or déjà vu (a feeling you have been somewhere or done something before), Hearing voices in your head Parietal Lobe Difficulty speaking or understanding what is said to you, Problems with reading or writing, Loss of feeling in part of the body Occipital Lobe Visual problems and loss of vision of one side Cerebellum Poor coordination, Uncontrolled movement of the eyes, Neck stiffness, Dizziness Brain Stem Poor coordination, Drooping eyelid or mouth on one side, Difficulty swallowing, Drooling of saliva, Difficulty speaking, Seeing double (diplopia) Pituitary Gland Irregular or infrequent periods in women, Infertility in men and women, Lack of energy, Weight gain, Mood swings, High blood pressure, Diabetes, Large (overgrown) hands and feet. Spinal Cord Pain, Numbness in part of the body, Weakness in the legs or arms, Loss of control of the bladder or bowel Meninges Headache, Sickness, Problems in vision, Problems with movement It is important to remember that there are many other causes for the symptoms mentioned above. If you are worried you need to go to a specialist doctor (neurologist or Neurosurgeon). In elderly people, vague symptoms of memory loss, personality changes and difficulty in walking can be put down to getting older. If several such symptoms develop in less than 6 months, it is worth checking in with a specialist doctor. Brain Tumours \| 11 12 \| JASCAP / BTF 4. Types of primary brain tumour Malignant gliomas Gliomas: Tumours arising from glial cells of the brain are called gliomas. Gliomas make up about 30% of all brain and 80% of all malignant brain tumours. Glioblastomas (GBM) These are highly malignant brain tumours. And are also the commonest primary brain tumours. Glioblastomas are highly cancerous as the tumour cells grow rapidly nourished by a meshwork of blood vessels feeding the tumour cell. As these tumours arise from normal brain cells, they can easily invade the normal brain but seldom do they spread beyond the brain. This tumour represents about 20% of all primary brain tumours and about 60-75% of all astrocytomas. They increase in frequency with age. Approximately 5% children are affected by glioblastomas. These tumours are commonly found in the cerebral hemispheres.GBM require a multimodal treatment approach. The mainstay of treatment is safe removal of as much tumour as possible through surgery followed by focal radiotherapy to the brain with simultaneous use of temozolomide (taken by mouth) and long term use of temozolomide for six to twelve months. The prognosis of these tumours may not be as good as low grade astrocytomas but majority of them can be controlled for a long time. It has been shown that glioblastoma patients in whom the MGMT gene is shut off by a process called methylation also have prolonged survival rates. Astrocytomas - Astrocytomas - The tumour arises from glial cells called astrocytes. In adults, astrocytomas most often arise in the cerebral hemisphere. In children, they occur in the brain stem, the cerebrum, and the cerebellum. Astrocytomas can be slow growing (low grade) or fast growing (high grade). Sometimes low grade astrocytomas can transform into high grade tumours. A gradeIII astrocytoma is sometimes called an anaplastic astrocytoma. Grade-IV astrocytomas are also called GBM as described above. These are malignant (high grade) brain gliomas and can sometimes spread to other parts of the brain. Low grade astrocytomas are grade-I & II tumous and are indolent. These are generally seen in children and young adults. In children they are commonly called Brain Tumours \| 13 as pilocytic astrocytomas (Grade-I astrocytomas according to WHO classification).Primarily these tumours are treated by surgical resection. However, in some instances the tumour may be in critical location (near the optic nerve, thalamus or the brain stem) where radiation has to be employed. These tumours have a very good prognosis and usually do not transform to higher grade astrocytomas. Grade-II astrocytomas on the other hand exhibit a diverse spectrum of tumours.(e.g. are diffuse fibrillary astrocytoma pilomyxoid astrocytoma, pilocytic xanthoastrocytoma, and gemistocytic astrocytoma).The prognosis of grade-II astrocytomas is not as good as grade-I astrocytomas and majority (50-80%) transform into higher grade tumours over a period of several years. Studies have shown that even grade-II astrocytomas can be observed after complete resection. However such patients need to be observed carefully with yearly surveillance MRI and detailed studies of molecular markers of patients histopathology specimens. Sometimes, grade II tumours may have aggressive features on an MRI scan even though they look like low grade tumours under the microscope. In such a scenario, a careful decision regarding adjuvant radiation and/or chemotherapy should be taken in a joint multidisciplinary tumour board after consultation with the pathologist and radiologist who can give further inputs about the behavior of the tumour Ependymoma - The tumour arises from cells that line the ventricles or the central canal of the spinal cord. These cells called ependymal cells. These tumours constitute approximately 10% of primary brain tumours. They are most commonly found in children and young adults and can occur in any part of the brain or spinal cord. In older patients they tend to occur in the lower part of the spinal cord. Ependymomas can be high or low grade. Rarely, ependymomas can spread to other parts of the central nervous system, through the fluid that circulates around the brain and spinal cord. Complete resection of tumour is the main stay of therapy followed by local radiation in case of high grade ependymomas. Low grade ependymoma (grade-I) can be observed after complete surgical excision. Oligodendroglioma - This rare tumour arises from cells called oligodendrocytes that make the fatty substance called myelin that covers and protects nerves. It helps the nerve signals (impulses) to 14 \| JASCAP / BTF travel along the nerves more quickly. These tumours usually occur in the cerebrum especially in the temporal or frontal lobe. About 4% of primary brain tumours are oligodendrogliomas and represent about 10-15% of gliomas. They are most common in middle-aged adults. A low-grade oligodendroglioma is a slow growing tumour while an anaplastic oligodendroglioma is a more aggressive tumour and grows quickly. These tumours are treated by surgery followed by radiation and chemotherapy depending on the grade of the tumour. A special test called 1p19q chromosomal test is done in these tumours which predicts treatment outcome. Patients who have loss of 1p19q have a better prognosis than patients who do not have any loss of the chromosome Brain stem glioma - The tumour occurs in the lowest part of the brain. Brain stem gliomas most often are diagnosed in young children and middle-aged adults. Biopsy is seldom done in these tumours. Hence these tumours are diagnosed and graded by imaging (MRI).These tumours are considered to have a poor outcome as they cannot be surgically resected. Radiotherapy is the only modality of treatment in these tumours. The average survival of these tumours is 1 year if they are diffuse and located in pons while small localised tumours located in mid brain and medulla tend to do well with average survival of several years. Malignant non-glial tumours Non Glial Brain tumours: Some types of brain tumours do not begin in glial cells but from other types of cells in the brain. Common examples are Medulloblastoma - This tumour usually arises in the cerebellum, but may spread to other parts of the brain. Medulloblastomas are malignant tumours formed from poorly developed cells at a very early stage of their life. It is one of the common brain tumours in children. Very rarely, medulloblastomas may spread to other parts of the body. If they do spread to other parts of the brain or to the spinal cord, this is usually through the cerebrospinal fluid (CSF). Patients who have had a complete resection of tumour and do not have any evidence of spread (standard risk) have a good prognosis; 5 year survival of 75-80% while in patients where the tumour is left behind even after surgery or has spread( high risk) have poor Brain Tumours \| 15 prognosis; 5 year survival is approximately 30-40%. Surgery is the main treatment followed by radiation to the entire brain and spine and chemotherapy. However in very young children; who are less than 3 years, radiotherapy is not given. In such children, chemotherapy is given after surgery. Primitive neuroectodermal tumour (PNET) - These tumours appear identical to medulloblastomas under microscope, these are very aggressive tumours and primarily occur in the cerebrum but can spread to any part of the brain or spinal cord. These are rare tumours and often occur in young children. The treatment strategy is similar to Medulloblastomas. ATRT- Is also called Atypical Teratoid / Rhabdoid Tumour; this is a rare and high-grade tumour that occurs most commonly in children younger than 2 years. These tumours tend to be aggressive and frequently spread through the central nervous system. They occur in about 1-2 % of children. As these are fast growing tumours, patient becomes symptomatic quite quickly which develops in days to weeks. Presently, ATRT is being diagnosed by testing the INI-1 gene mutation which is absent in these tumours. This is a new and expensive diagnostic test and is available only in few centres in India. These tumours are treated in the same way as medulloblastomas are treated although the prognosis of ATRT is not as good as medulloblastomas. Lymphomas and germ cell tumours Germ cell tumour of the brain - The tumour arises from a germ cell. Most germ cell tumours that arise in the brain occur in people younger than 30. The most common type of germ cell tumour of the brain is a germinoma. A germ cell tumour grows from primitive developing cells that form in the embryo and develop into the reproductive system. They are also called embryonal tumours. Most occur outside the brain, in the chest or abdomen, but they can occur in the brain. In the brain they are most commonly found in the area close to the pineal gland and the pituitary gland. Germ cell tumours sometimes produce chemicals that can show in the blood. The chemicals include alpha fetoprotein (AFP), human chorionic gonadotrophin (HCG) and placental alkaline phosphatase (PLAP). So sometimes these tumours can be diagnosed with a blood 16 \| JASCAP / BTF test. They are often picked up when they are still small. They can block the circulation of fluid around the brain and so they tend to cause symptoms early on. Germinomas tend to good prognosis, as over 90% of patients can be effectively treated with radiation therapy. In general, they carry an excellent prognosis, with cure in well over 90% of patients in germinomas.However; non germinomas behave aggressively with survival rate of just 50%. Lymphomas - Tumours which arise from the lymphatic system are called lymphomas. Although the brain and the spinal cord do not have an inherent lymphatic system, lymphoma can start in the brain or spinal cord. This are called primary cerebral lymphoma or primary central nervous system (CNS) lymphoma. Fewer than 1 in 20 brain or spinal cord tumours (5%) are primary CNS lymphomas. Most are a type of lymphoma called diffuse large B cell non Hodgkin lymphoma. Lymphoma is a cancer of the lymphatic system. These tumours are treated differently to other types of brain tumour. These tumours do not carry a good prognosis. Average survival of these patients is around 3 years. Benign brain tumours Pituitary tumours - The pituitary gland is a small gland on the underside of the brain. Tumours arising from the pituitary gland are called pituitary adenomas as most pituitary tumours are benign (non cancerous), these are slow growing tumours that start in pituitary tissue cells. Tumours larger than 1 cm are called macroadenomas while tumours smaller than 1 cm are called microadenomas. Tumours larger than 4 cm are called giant macroadenomas. Some pituitary adenomas produce hormones and are called secretory tumours. Others do not produce hormones and are called non secretory tumours. The treatment depends on whether your tumour produces hormones or not. Hormone producing adenomas Prolactinomas: which cause milk production by the breasts, infertility or loss of sex drive. Steroid producing tumours: which cause Cushing’s syndrome (weight gain on the trunk of the body, a moon face, acne, mood Swings, diabetes, and high blood pressure). Brain Tumours \| 17 Growth hormone producing tumours: which cause excess height in young people or acromegaly in adults (overgrowth of hands, feet, lower jaw and brows). Thyroid stimulating hormone producing tumours: which cause an overactive thyroid gland leading to weight loss, feeling hot, irregular periods, moods swings and other symptoms. Brain Tumours \| 17 Adenomas that don’t produce hormones Pituitary tumours that do not produce hormones are called non secretory adenomas. They usually press on the nerves and cause changes in your eyesight. They may also affect the normal pituitary gland tissue so that you have lower levels of some hormones. Meningiomas -This tumour arises in the meninges. It usually grows slowly. They are more common in older people and in women. These tumours start in the tissues covering the brain (membranes). They are usually benign (not cancerous) but some are atypical. This means that they behave more aggressively than normally expected for meningiomas. They can grow into surrounding brain tissue and may come back after they have been removed. The estimated 5-year survival for low grade meningiomas varies from 70-90%. Malignant and atypical meningiomas have a far more aggressive clinical course with a 5-year survival of 40-60%. Schwannoma - A tumour that arises from a Schwann cell. These cells line the nerve that controls balance and hearing. This nerve is in the inner ear. The tumour is also called an acoustic neuroma. They start in the nerve that runs from the ears to the brain and controls hearing and balance. They are nearly always slow growing, do not spread, and are thought of as benign brain tumours. Often, they have been there a long time by the time they are diagnosed. Acoustic neuromas are found most often in older people. Loss of hearing in one ear can be a sign of acoustic neuroma. Rarely, they are associated with one form of a genetic condition called neurofibromatosis type 2 (NF 2). In these cases, they are usually diagnosed at a much younger age, and are present on both sides (bilateral), and people affected may also develop meningiomas. Craniopharyngioma - The tumour grows at the base of the brain, near the pituitary gland. This type of tumour most often occurs in 18 \| JASCAP / BTF children, teenagers and young adults. Craniopharyngiomas are very rare benign tumours. Craniopharyngiomas do not usually spread, but they occur close to important structures in the brain and can cause problems as they grow. They can cause changes in hormone levels and problems with eyesight. Children with craniopharyngioma can have weight gain and growth problems. A 5-year survival rate of 70-80% is achieved with surgery and adjuvant radiation therapy. The 10-year overall survival is 60-75%. 5. Diagnosing brain tumours Based on the above mentioned symptomatology which is always backed up with a sound history taking, the next step is the diagnostic imaging techniques that have evolved immensely over the past years and have become a valuable asset in diagnosis of central nervous system tumours. These tests are done on an outpatient basis and you do not have to stay back in the hospital. Computerized Axial Tomography (CAT scan) [Figure 3] A CAT scan is a computerized scan using X-rays. It is the First line imaging modality for brain tumours. Brain tumours usually show up on this type of scan. When you have your CAT scan, you will be injected with a chemical during or just before the scan. This is called a contrast medium. It is a dye that circulates in your bloodstream to the brain and makes the CT pictures of the brain clearer. These scans usually give a very clear picture of the brain and will almost certainly show up any brain tumour that is present. You will be injected with a special dye called a contrast which will make the images clearer. Specialized MRI scans called magnetic resonance angiography (MRA scans) can show the blood vessels in the brain. Magnetic resonance spectroscopy (MRS scans) looks at chemicals in the tumour as illustrated in Figure 5 Perfusion MRI is a specialized MRI technique which measures the rate of blood flow and the amount of blood volume in the tumour vies-a-vies normal brain. The acquired data are then processed to obtain perfusion maps with different parameters, such as BV (blood volume), BF (blood flow). A special type of MRI scan called a functional MRI (firm) is undertaken for planning complex surgereries. During this scan the doctor will ask you to do things like move your hand, speak or read. These scans are used to help plan surgery when the tumour is close to an area controlling one of these functions. It is very important to tell your doctor if you have any metal inside your body as this may mean you cannot have an MRI scan. These tests are used not only to complement the pathological diagnosis but also help in determining to what extent the tumour will respond to a given treatment and also predict for the final outcome. 22 \| JASCAP / BTF Examples of special molecular tests are: • Ip 19q LOH studies for oligodendrogliomas or mixed oligo astrocytomas • MGMT studies for Glioblastomas and Anaplastic Astrocytomas • EGFR expression/mutation studies for glioblastomas • Loss of INI-1 protein for ATRT • IDH mutation analysis to identify good prognostic brain tumours. These tests are expensive and not done for all the brain tumour patients. Your specialist doctor will tell you whether you are a candidate for these tests. Test for markers in blood and CSF: You may have blood tests to check for specific chemical markers in the blood. Some tumours, such as pineal region tumours or germ cell tumours may change the level of particular hormones and your doctor will check for these markers. For example, if you have a germ cell tumour in the brain, your doctor will check for Alfa feta protein (αFP), Beta Human Chorionic Gonadotropin levels (βHCG), Lactate Dehydrogenase (LDH) els in the CSF fluid and in your blood. CSF fluid is also tested for LDH levels in case PNET, Medulloblastomas and ATRT. Biopsy Usually a biopsy is used to confirm the diagnosis. Very often a biopsy will tell the treating doctor the exact type of tumour. It is also done as a part of an operation to remove the tumour. The tumour tissue is then sent to the laboratory where it is examined by a pathologist (a doctor who specializes in examining cell or tissues under microscope) Decision making process Decision regarding the management of these tumours should always be taken in a multi disciplinary meeting and the treatment plan formalized. Patients requiring multidisciplinary postoperative management, those with a diagnostic or therapeutic dilemma and patients eligible for clinical research study should be discussed by Brain Tumours \| 23 a multi disciplinary team comprising of experienced neurosurgeons, radiation oncologist, medical oncologist, radiologists and pathologists. Such meetings usually take place at tertiary care cancer centres and in academic hospitals across India. 6. Treating Brain Tumours Goals of management - The management of brain tumours requires multimodal approach. The basic goal of the treatment of brain tumours is to safely remove the tumour as much as possible (also called maximum safe resection) and to prevent it from recurring again by giving adjuvant treatment in the form of either radiotherapy or chemotherapy. Treatment options for brain tumour The most suitable treatment for a brain tumour depends on the type of tumour. It also depends on its location in the brain its size and grade. Your oncology team will work together to decide on the best treatment for you. Your specialists will also consider your age and general health, and your own wishes about your treatment. In general there are 3 types of modalities available for treating brain tumours. Treatment for brain tumours is based on many factors, such as: • Your age, overall health, and medical history • The type, location, and size of the tumour • How likely the tumour is to spread or recur • Your tolerance for specific medications, procedures, or therapies Surgery Taking out a growing brain tumour is important because as the tumour gets bigger it increases the pressure inside the head. It is this increased pressure that causes some of the symptoms of brain tumours. The surgeon is sometimes able to remove the whole tumour but often this is not possible and they can only remove part of it. Even if your surgeon doesn’t think your brain tumour can be completely removed, they are still likely to want to take out as much as possible. 24 \| JASCAP / BTF Figure 6 : Photograph showing how a craniotomy is performed to approach the brain Types of Neurosurgical procedures 1. Craniotomies: This type of surgery involves opening of a part of the skull bone to remove the tumour. After the surgery the bone is replaced back and fixed usually with screws and plates. The tumour removal is usually carried out using the operating microscope to magnify the operating area. Depending on the amount of tumour removed during surgery, the procedure can be further classified as: A. Biopsy: A very small amount of tumour is removed, for obtaining a diagnosis. A small amount of tumour is sent to the pathologist to confirm the type of tumour on histopathology. These procedures are done for tumours which are dangerous to remove, because they are very deep seated and close to functional areas. Removing tumour situated in these areas can cause damage to patient’s condition e.g. hemiplegic (weakness of one side of the body). Biopsy is also done for tumours like lymphoma which responds well to chemo and radiotherapy. Biopsy may also be done in patients who are extremely sick to undergo major surgical procedure. B. Debulking surgery: In this type of craniotomy procedure, the tumour is removed as much as possible, without causing damage to the patient’s condition. In malignant brain tumour, it is not possible to remove the tumour completely because tumour is present in functioning areas of brain. Hence the need to give radiation and chemotherapy to control the remaining tumour. C. Complete excision: This is a type of surgery, where the tumour is completely removed. It is usually possible in benign (non cancerous) tumours like meningiomas, schwannomas, grade 1 gliomas. Surgery is curative in these cases and radiotherapy and chemotherapy may be avoided. After surgery, you may experience pain in the operated area or small fluid collection below the wound. Sometimes a drain may be kept to remove the collecting fluid and a crepe bandage tied around the head. Most of the pain will be relieved by simple analgesic like paracetamol (crocin) or combiflam (Ibrufen+ paracetamol). You can take a head bath after a few days. If there is leakage from the wound, you are advised to immediately contact your surgeon. You will be discharged within 5-7 days, providing there are no complications. 26 \| JASCAP / BTF 2. Shunts and CSF diversions: The shunts are used to divert excess CSF (brain fluid) out of the brain usually to the abdomen. They help to reduce the pressure in the brain. A shunt is a tube made of inert silicone rubber. A shunt usually put, remains for life in the patient. Shunt procedure is done in case of hydrocephalus (fluid collection in the brain), arising due to tumour or infection. 3. Endoscopics surgery: These are surgeries carried out using an endoscope. A small scope (camera) with instrument is passed through the nose to operate specific tumour in the basal part of the brain, eg pituitary tumours. There are usually no external scar marks in this type of surgery. Endoscopes are also used to biopsy tumours in the ventricles (cuff containing spaces) and perform internal shunting procedures (endoscopic ventriculostomy) 4. Stereotactic frame based biopsies: The stereotactic frame is used to biopsy deep seated lesion of the brain. A metallic frame (stereotactic frame) is fixed around the patients head using local anesthesia. A CT/MRI scan is obtained after fixing the frame. Using this CT/MRI scan, a biopsy can be obtained in the operation theater using the frame. You (patient) will need to undergo a CT scan, after 4hrs of biopsy, just to make sure that everything is well. You will be discharged in a couple of days after the biopsy. 5. Navigation guided surgeries: This is a specialized machine (Navigation system) which helps guide the surgery. A special CT/ MRI scan is first loaded on to the machine. This navigation system works like a GPS (global positioning satellite), help to locate the tumour, planning incision, & guiding the surgeon during the surgery. A special ultrasound in this system help the surgeon to know whether the tumour is fully resected (removed). 6. Ultrasound guided surgeries: This is a type of surgery where the ultrasound in used to locate the tumour and also to know if any tumour is remaining behind. 7. ALA guided surgeries: This is a special type of surgery which uses a dye (ALA Dye). The patient consumes this dye before surgery. During the surgery, the surgeon can see the brain tumour as a bright fluorescent mass, using a special microscope. This helps the surgeon to remove maximum amount to tumour, some of which could be missed in normal light. Brain Tumours \| 27 8. Awake surgeries: This is a type of brain surgery in which the patient is awake during the surgery. This type of surgery is used for tumour which are close functioning areas of the brain, hence at a high risk for problems after surgery. The patient is given local anesthesia to block the pain sensation, however he is conscious. The patient is asked to perform movement of limbs and speak during the surgery for monitoring. The surgery is stopped, if patient develop any complications, thereby limiting the damage. What is the routine followed before brain surgery: OPD : Detailed history and examination is done 1. Radiology (CT scans & MRI scans ) are reviewed. 2. Routine investigations: blood test, ECG, X-rays are ordered. 3. Repeat / New MRI may be ordered if previous MRI is old or incomplete. 4. PAC: A pre-anesthetic check up is done by the anesthetist to check for anesthesia fitness before undergoing surgery. New investigations like echo cardiograph, stress test, etc may be ordered if required for fitness. The patient is given a risk grade (ASA grade) which tells how risky the surgery is going to be for the patient. Next Visit: All the investigations are reviewed and decision for surgery is taken. The risk and complication rate for the surgery are discussed with the patient and his relatives. Date of admission for surgery is given. Admission and pre-op preparation Patient is admitted usually a day prior to the surgery. All the medications are continued in the wards. Consent: The patient / or (his relative is patient is unable to consent) is explained regarding the surgery, which he will undergo, including the risk and complications of the procedure involved. After understanding the above, patient has to sign a consent form if he agrees to undergo the procedure or surgery. Shaving: The head is shaved partially or fully for the desired surgery. You may request your surgeon if you do not want to shave your head. An 28 \| JASCAP / BTF incision line shaving can be done in the operation theatre prior to surgery. You will be kept fasting overnight or as directed by the treating doctor, before the surgery. You may be given oral /intra venous medication in the morning of the surgery as advised. Medications after surgery 1. Anticonvulsants: These drugs are routinely started for patients undergoing cranial surgery except in cases of cerebellar or brainstem tumours. These drugs help to prevent seizure/fits in these patients. They have to be taken regularly and for long period of time.(>2 years). e.g. Valproate, levetiracetam. 2. Anti-oedema: These include steroid and injectable Mannitol. These help to decrease the swelling in the brain because of the tumour and help to temporarily stabilize the condition of the patient before surgery. They are also continued after surgery for a few days. Risk /Complications of brain surgery Brain is an extremely critical organ which controls all other parts of the body. Hence damage to brain structures by tumour or during surgery can give rise to deficits or problems in rest of the body. As with any surgery there are risk/complication associated with brain surgery. The risk varies from patient to patient depending on the clinical condition of the patient, type of tumour, location of tumour etc. Risk of brain surgery includes: 1. Convulsion also called Fits 2. Inability to move the limbs 3. Infection (meningitis) 4. Blurring of vision (sight), hearing, swallowing or breathing. 5. Difficulty while balancing. After Surgery The patient after surgery is shifted to ICU (intensive care unit) for monitoring after surgery. Most patients will be awake after the surgery. Some of the patients may be electively put on a ventilator to help in the post operative recovery. Brain Tumours \| 29 A CT scan / MRI brain is done on the day after the surgery to rule out any problem occurring during or after surgery. Patient may remain for a longer time in the ICU in presence of any complication. Patient is sent to the wards after the stay in the ICU. If the patient is normal after surgery, he is encouraged to engage in normal activity and diet. In case of any neurological deficits (problems), a Physiotherapist and later an Occupational therapist helps the patients in process of recovery, by various exercises and supporting splints (Devices to help maintain normal posture.) Sometimes, the patient may need to see a speech/swallowing therapist, ophthalmologist, and endocrinologist for specific problem arising due to disease or after surgery. Discharge and Follow-Up Patients are usually discharged when they are stable and can be managed safely at home. They are given a discharge card which specifies what medications are to be taken and for how long. A date is given for suture (stitch) removal and collecting the histopathology report. After the histopathology report, patients requiring adjuvant therapy(that is - radiation therapy and /or chemotherapy) are referred to the respective specialist doctors. Patients are asked to follow up with the neurosurgical services after completion of the adjuvant treatment. Radiotherapy Radiotherapy is an integral component in the multimodality management of primary brain tumours with potential impact upon its control, symptom improvement, and even survival for malignant brain tumours. Following maximal safe resection, adjuvant radiotherapy is indicated for all high-grade primary brain tumours. For completely excised benign tumours, such as pituitary adenomas and benign meningiomas, currently there is no role of adjuvant radiotherapy. For low grade gliomas too, with no residual tumour on imaging, close observation alone is a reasonable option. 30 \| JASCAP / BTF However radiotherapy is recommended in such tumours either if a residual tumour is evident on post operative imaging or if tumour progression is documented on serial imaging. For tumours in the functional areas of the brain where only a partial excision or biopsy if possible, radical radiotherapy is needed to improve outcome. What is Radiotherapy? It is a type of treatment by which cancer cells are destroyed by using high energy X-rays. This treatment is given by carefully planned radiation beams delivered from outside the body (external radiotherapy or teletherapy).The radiation is delivered such that only the tumour is targeted while sparing the surrounding normal tissue. Radiotherapy is given as a series of short daily sessions from Monday to Friday with rest on weekends. The dose and duration of radiotherapy depends upon the type of tumour, grade of tumour and the goal of treatment (whether palliative or radical).Thus, the treatment may vary between 1 week to 6.5 weeks. Your treating oncologist will discuss about the entire treatment plan and the effects of treatment with you before starting the radiotherapy. usually radiotherapy treatments are outpatient procedures. What to ask your doctor about brain tumour radiotherapy You may wish to make a list of questions you would want to ask your treating oncologist before starting radiotherapy:- • Is there a need for radiotherapy? • Is there any other treatment I should have along with radiotherapy? • What are the side effects of this treatment? • What will be the duration of radiotherapy? • What diet I should be having during radiotherapy? • Is there anything I can do to help myself recover more quickly after radiotherapy? • How often will I have to go to the hospital to have treatment? • Will I be able to do my regular work during radiotherapy? • Will I be able to go back to work after radiotherapy? Planning for radiotherapy Radiotherapy treatment is a planned procedure which involves multiple steps. You will have 2 or 3 outpatient appointments before you start radiotherapy. The first is usually to make a mask of your face to use during the treatment. The further appointments are so that the radiotherapy doctor (neuron oncologist) can carefully plan your treatment. Treatment mask and treatment simulation [Figure 8] Before you start your treatment you go to the hospital mould room to have a mask made. The mask is sometimes called a shell or mould and is made of an orfit (a special type of mesh plastic). It covers the whole of your face and the front of your head. The mask keeps your head completely still while you are being treated.. This is a sheet of plastic that is soft when warm but it hardens as it cools. The warmed plastic is draped over your face and shaped to your face and head. It has holes in the mesh so you can breathe easily. When the plastic cools it gives an exact impression of your face and head. The procedure of mask making takes around 20 to 30 minutes. The radiation personnel makes marks on the mask to delinate the radiation fields. Please remember that radiotherapy is a very accurate technique. The face mask will keep you steady so that radiation can be delivered accurately. 32 \| JASCAP / BTF Planning for treatment [Figure 9] A team of oncologist, physicist and radiation technologists plan radiotherapy very carefully. Once the mask is made, you will be asked to lie under a CT scanner (CT simulator) which takes images of the area to be treated. You may be given an injection of dye (contrast) into a vein to help the doctor see this area more clearly. The photo shows a patient having a planning CT scan with the mask on in some patients and MRI is also taken. After the scan you can go home. Your treatment team use the CT images and the MRI images, and feed into a special computer called a treatment planning system (TPS). They use this information to determine • The exact shape of the tumour • Where important structures are in relation to the tumour (for example, your eyes, spinal cord) • The direction to aim the radiation beams so that they avoid all the normal structures • Radiation dose to the tumour vis-a vis and normal tissue. In order to have an optimal plan, the physicist a nd the oncologist sit together using the images to works out the optimal treatment plan they aim to give a high radiotherapy dose to the cancer cells and keep the dose to the normal brain tissue as low as possible. They may use radiotherapy beams from a number of different angles. Figure 9 : Photograph showing how radiation beams are planned for brain tumours on the Treatment Planning System (TPS) Brain Tumours \| 33 Having brain tumour radiotherapy Once your treatment plan is finalized by your treating team, on the day of radiation therapy, you will be asked to you lie on the treatment table. The radiation technologist fits your mask and attaches it to the table. The radiation technologist will help to position you on the couch and make sure that you are comfortable. Each treatment only takes a few minutes. Your radiation treatment will start once the radiation technologist is satisfied that you’re positioned perfectly. All the personnel will have to leave the room for the minute or two when the machine is switched on. But the staff will be able to hear you through an intercom and see you on a TV screen, so you can call if you need them. Initially, the radiation technologists take pictures of the tumour and compare them to your planning CT scan. The couch may then move as they adjust your position. They then turn on the machine to give the actual treatment. During treatment you may hear a buzzing sound. You will not be able to feel it at all. But you must lie very still for the few minutes it takes to treat you. Types of radiotherapy techniques a. Focal radiotherapy: Radiation is delivered to only a part of the brain where the tumour is located. This is undertaken with the help of 3-D planning systems so that the radiation beams are directed towards the tumour, sparing the normal brain. b. Crainospinal radiotherapy: Radiation is given to entire brain and the spinal cord and its coverings (meanings).This type of treatment is undertaken in patients with medulloblastomas and germ cell tumours. It is a highly specialised type of radiotherapy technique and should be done under proper supervision of expert radiation oncologists. c. Whole brain Radiotherapy (WBRT): Whole brain Radiotherapy (WBRT) is given to patient’s with secondary (metastatic deposits) brain cancer and patients with Primary lymphoma of the brain. Radiotherapy delivery tech niques a. Three-dimensional (3D) conformal radiotherapy (3DCRT): With the help of 3-D planning systems, we can see the tumour in 34 \| JASCAP / BTF Three dimensions (3D), width, height and depth, using CT scans and MRI scans. The information from these scans feeds directly into the radiotherapy planning computer. So doctors can see the treatment area in 3 dimensions. The computer programmed then designs radiation beams that follow the shape of the tumour more closely. So the radiation beam avoids healthy tissue as far as possible. This is called 3D conformal radiotherapy (3DCRT). The main benefit with conformal radiotherapy is that it is more precise, because it allows doctors to plan in 3D. Conformal radiotherapy can give a better chance of killing the cancer by delivering a higher dose of radiation straight to it. A very small volume healthy tissue is included in the radiotherapy field and so you are likely to have fewer long term side effects. 3D CRT treatment is delivered on linear accelerators with special attachments called multileaf collimators. Almost all the primary brain tumours are treated by 3D conformal radiotherapy. b. Intensity modulated radiotherapy (IMRT): One type of conformal radiotherapy is called intensity modulated radiotherapy (IMRT). Like conformal radiotherapy, IMRT shapes the radiation beams to closely fit the area where the cancer is. But it also changes the radiotherapy dose depending on the shape of the tumour also called as modulation of radiation intensity. This means that the central part of the cancer receives the highest dose of radiotherapy and a surrounding area of tissue gets lower doses. IMRT can also create an indented (concave) area within the radiotherapy field to avoid structures that would be damaged by the radiotherapy. This is very helpful in brain tumours to avoid spillage of radiation dose to important functional areas of the brain. Treatment is delivered using linear accelerators with special attachments called Multi Leaf Collimators (MLC).These are motorised MLC’s that move dynamically around the patient during radiation treatment to modulate the intensity of radiation beam so that the centre of the tumour gets maximum radiation dose and the surrounding normal tissues are spared of the radiation. c. Stereotactic conformal radiotherapy (SCRT) and Stereotactic radiosurgery (SRS) [Figure 10] Brain Tumours \| 35 Stereotactic radiotherapy is a way of targeting radiotherapy very precisely at the tumour. You have the radiotherapy beams aimed at the tumour from many different directions around your head. This type of treatment is not available at all hospitals because it needs specialist equipment and skills. Since this treatment is very precise, your head should be immobilized in exactly the same position and should not move during treatment. This treatment is delivered by a linear accelerator (LINAC) having special attachments called micro multiyear collimators (mMLC) or by specially designed cobalt -60 machines. Stereotactic radiotherapy treatment is usually divided into between 25 and 30 daily doses called fractions. If you only have 1 fraction of very high dose stereotactic radiotherapy, this is called radiosurgery. Stereotactic radiotherapy planning is similar to external radiotherapy planning where images will be captured on a CT and MRI scan. These images are fed to a computer which has special software to plan stereotactic radiotherapy treatment. This means that the normal brain tissue surrounding the tumour gets a very low dose of radiation. So you will have fewer side effects than with conventional external beam radiotherapy. You must understand that not all brain tumours are treated with stereotactic radiotherapy or stereotactic radiosurgery. Your treating radiation oncologist will discuss with you if this treatment is required or not. If this treatment is is being planned for you, your radiation oncologist will discuss in detail about the entire procedure. Tomotherapy and Volumetric Arc Therapy Tomotherapy is a combination of image guided radiotherapy and IMRT. The machine looks more like a CT scanner with an additional attachment of linear accelerator. 100000 பெண்களில் 1.4 லிருந்து 2.6 பேருக்கு என்ற அளவில் தொடக்க நிலை மூளைக்கட்டியின் தாக்கம் இருக்கும் என்று இந்திய மருத்துவ ஆராச்சிக்கழகத்தின் (Indian council of Medical Research –ICMR) தரவுத்தளத்திலிருந்து தெரியவருகிறது. நாட்டில் ஒவ்வொரு வருடத்திலும் கண்டறியப்படும் மொத்த புற்று நோய் பாதிப்புக்களில் இதன் பங்கு 2 வருடங்கள்). உதாரணமாக, வால்போரேட்,லெவிடிராசெடம் (Valproate, levetiracetam) 2. நீர்க்கட்டு தடுப்பான் (Anti-oedema) இவை இயக்க ஊக்கி மற்றும் ஊசி மூலம் செலுத்தக்கூடிய மான்னிடால் (Mannitol) போன்ற மருந்துகளை உள்ளடக்கியவை. இந்த மருந்துகள் கட்டிகள் காரணமாக மூளையில் ஏற்படக்கூடிய வீக்கத்தை குறைத்து அறுவை சிகிச்சைக்கு முன் நோயாளியை தற்காலிகமாக நல்ல நிலையில் வைத்திருக்க உதவுகிறது. அறுவை சிகிச்சைக்குப் பின்னரும் சில நாட்கள் இதைத் தொடரவேண்டும். மூளை அறுவை சிகிச்சையில் உள்ள ஆபத்துக்கள்/ சிக்கல்கள் மூளை உடலின் மற்ற அனைத்து உறுப்புக்களையும் கட்டுப்பாட்டில் வைத்திருக்கும் ஒரு மிகச் சிக்கலான உடலுறுப்பு. ஆகவே கட்டிகளாலோ அல்லது அறுவை சிகிச்சையின் போதோ மூளைக்கு ஏற்படும் எந்த ஒரு பாதிப்பும் மற்ற உடலுறுப்புக்களில் குறைபாடு அல்லது பிரச்சினையைத் தோற்றுவிக்கும். எந்த ஒரு அறுவை சிகிச்சையைப் போன்றே மூளை அறுவை சிகிச்சையும் ஆபத்து/சிக்கல்களுக்கு உட்பட்டது. இந்த ஆபத்துக்கள் வெவ்வேறு நோயாளிகளுக்கு இடையில் அவர்களின் மூளைக்கட்டியின் தன்மை, அது அமைந்திருக்கும் இடம் போன்ற மருத்துவ நோய்க்கூறுகளைப் பொருத்து மாறுபடுகிறது. மூளை அறுவை சிகிச்சையில் உள்ள ஆபத்துக்களில் இவையும் உள்ளடங்கும்: 1. வலிப்பு என்று அழைக்கப்படும் உடல் நடுக்கம் 2. கை கால்களை அசைக்க இயலாமை 3. நோய்த்தொற்று (மூளை உறையழற்சி --meningitis) 4. மங்கலான பார்வை (பார்வைத்திறன்) கேட்கும் திறன் குறைபாடு, விழுங்குவது அல்லது மூச்சு விடுவதில் சிரமம். 5. சமநிலை பேணுவதில் சிரமம். அறுவைசிகிச்சைக்குப் பிறகு: அறுவை சிகிச்சை முடிந்தவுடன் அதற்குப் பிறகான தொடை கண்காணிப்புக்காக நோயாளி தீவிர சிகிச்சைப் பிரிவுக்கு (ICU--intensive care unit) மாற்றப்படுகிறார்.பெரும்பாலான நோயாளிகள் அறுவை சிகிச்சை முடிந்தவுடன் விழிப்பு நிலையிலேயேதான் இருப்பார்கள். சில குறிப்பிட்ட நோயாளிகளுக்கு மட்டும் அறுவை சிகிச்சையினின்று விரைவில்மீண்டு வர உதவும் பொருட்டு செயற்கை சுவாசக் கருவி பொருத்தப்படும். அறுவை சிகிச்சை முடிந்த மறுநாள் அறுவை சிகிச்சையின் காரணமாக அல்லது அதற்குப்பிறகு எந்த ஒரு பிரச்சினையும் இல்லை என்பதை உறுதி செய்து கொள்ளும் பொருட்டு ஒரு சிடி/எம்ஆர்ஐ அலகீட்டு வரைவு எடுக்கப்படும். பிரச்சினைகள் ஏதாவது இருந்தால் நோயாளி நீண்ட நாட்களுக்கு தீவிர சிகிச்சைப் பிரிவில் இருக்க நேரிடும். ஐசியூவில் இருந்த சில நாட்களுக்குப்பிறகு மருத்துவ மனையின் தங்கும் அறைக்கு மாற்றப்படுவார். அறுவை சிகிச்சைக்குப் பிறகு நோயாளி குணத்துடன் இருப்பது உறுதியானால் அவரை வழக்கமான உணவு மற்றும் நடவடிக்கைகளில் ஈடுபடுமாறு ஊக்கப்படுதப்படுவார். நரம்பு மண்டலம் சார்ந்த குறைபாடுகள் (பிரச்சினைகள்) இருந்தால் ஒரு உடலியல் மருத்துவரும் பிறகு ஒரு தொழில்வழி சிகிச்சையாளரும் நோயாளி விரைவில் குணமடைந்து மீண்டு வருவதற்கு பல்வேறு செயல்பாட்டு பகுதிகளில் இருக்கும் கட்டிகளில் அதன் ஒரு பகுதியை மட்டுமே நீக்க அல்லது திசுஅய்வு செய்யும் வாய்ப்பு மட்டும் இருந்தால் அதில் நல்ல விளைவை அடைய தீவிர கதிரியக்க சிகிச்சை மேற்கொள்ளுவது அவசியம். கதிரியக்கச் சிகிச்சை என்றால் என்ன? புற்றுநோய் உயிரணுக்களை உயர் சக்தி கொண்ட எக்ஸ் கதிர்களைப் பயன்படுத்தி அழிக்கும் ஒரு வகை சிகிச்சை. இந்த சிகிச்சை மிக கவனமாக திட்டமிடப்பட்ட கதிரியக்கக் கற்றைகளை உடலுக்கு வெளிப்புறமிருந்து ( வெளிப்புற கதிரியக்கச் சிகிச்சை அல்லது தொலை சிகிச்சை) செலுத்துவது. அருகிலுள்ள திசுக்களை தவிர்த்து, குறி வைக்கப்பட்ட கட்டிகளின் மீது மட்டும் தாக்கத்தை ஏற்படுத்தும் அளவில் மேற்கொள்ளப்படும். கதிரியக்கச் சிகிச்சை சிறு அளவில் திங்கட் கிழமை முதல் வெள்ளிக்கிழமை வரை தினந்தோறும் வார இறுதி நாட்களை ஒய்வுக்காக ஒதுக்கிவிட்டு தொடர்ந்து செய்யப்படும் சிகிச்சை. கட்டியின் வகை, அதன் The appeals in this batch, involving similar questions between the same parties, have been considered together and are taken up for disposal by this common judgment. 2. Civil Appeal Nos. 7164 of 2013 and 7165 of 2013, filed respectively by the revenue and the assessee, are directed against the final judgement and order dated 10.09.2004, passed by a Division Bench of the High Court of Signature Not Verified Digitally siJgneud bdy icature at Madras in W.P. No. 25081 of 2002, whereby the High Court has DEEPAK SINGH Date: 2020.06.29 14:58:27 IST Reason: allowed the writ petition filed by the assessee while holding, inter alia, that though the purchase turnover, with respect to the purchase of empty bottles from unregistered dealers under bought note, is exigible to purchase tax under Section 7-A of the Tamil Nadu General Sales Tax, 19591 but, the assessee is entitled for the benefit of Clarifications dated 09.11.1989 and 27.12.2000 issued by the revenue till the same were withdrawn prospectively by the Clarification dated 28.01.2002 and therefore, the revenue is not entitled to levy purchase tax for the said turnover of purchase of empty bottles for the assessment year 1996-97. The assessee has filed another set of appeals in Civil Appeal Nos. 4416-4419 of 2014 against the order of the High Court dated 05.12.2013, passed in Tax Case (Revision) Nos. 1667,1669, 1857 of 2008 and 13 of 2009, wherein the High Court has held that the assessee is liable to pay purchase tax under Section 7-A of the Act for the assessment years 1986-87 to 1989-90 on the turnover of purchase of empty bottles from the unregistered dealers while following its aforesaid earlier order dated 10.09.2004. 3. Put in a nutshell, these matters involve the interpretation of Section 7-A of the Tamil Nadu Act, providing for levy of purchase tax under certain circumstances, with root questions as to whether purchase tax is leviable on the purchase turnover of empty bottles purchased by the assessee in the course of its business of manufacture and sale of Beer and Indian Made Foreign Liquor2 and as to the operation and effect of the Clarifications dated 09.11.1989 issued by the Special Commissioner and Commissioner of 1 Hereinafter also referred to as ‘the Tamil Nadu Act’ or simply ‘the Act’. 2 ‘IMFL’ for short. Commercial Taxes, Chennai3 and dated 27.12.2000 issued by the Principal Commissioner and Commissioner of Commercial Taxes, Chennai4. On the sideways, a separate question is as to whether cash discount on the price offered by the assessee to the Tamil Nadu State Marketing Corporation Limited5 is taxable in view of Explanation 2(iii) to Section 2(r) of the Act? 4. As noticed, the impugned order dated 05.12.2013 in Civil Appeal Nos. 4416-4419 of 2014 is essentially based on the previous order of the High Court dated 10.09.2004 which is in challenge by the revenue as also by the assessee in Civil Appeal Nos. 7164 of 2013 and 7165 of 2013. Hence, we propose to deal with the cross-appeals against the order dated 10.09.2004 in necessary details. Civil Appeal Nos. 7164 and 7165 of 2013: Relevant Background 5. The assessee is a company incorporated under the Companies Act, 1956 and is engaged in the business of manufacture of Beer and IMFL products on the strength of license issued under the Tamil Nadu Indian Made Foreign Spirits (Manufacture) Rules, 1981 in its factory located at No. 7, Selva Street, M.M. Nagar, Valasaravakkam, Chennai – 600 087. It is an assessee on the file of the Commercial Tax Officer, Porur Assessment Circle. The assessee, for the purpose of the said business of manufacture of Beer and IMFL, purchased empty bottles from unregistered dealers situated outside the State as well as from non-dealers for the bottling of Beer and IMFL. It has been the case of the assessee that the said bottles were recycled after 3 ‘SCCT’ for short 4 ‘PCCT’ for short 5 ‘TASMAC’ for short use by the consumers and were re-filled with Beer and IMFL. The cost of bottles was Rs. 35.69 per case as against the manufacturing cost of Beer of Rs. 109.93 per case, taking the cost of bottles to 32% of the manufacturing cost. With respect to IMFL, the cost of bottles was Rs. 60.40 per case as against the manufacturing cost of Rs. 217.06 per case, which had been 28% of the manufacturing cost. According to the assessee, these bottles purchased against bought notes were the bottles which were already used, filled and sold for a price and continued to be available for re-use and further trading. It had also been the case of assessee that as per Rule 29 of the Tamil Nadu Brewery Rules,1983, the manufacturer had the option of filling the Beer either in bottles or casks or even kegs; that the entire Beer and IMFL manufactured by assessee was sold only to TASMAC, who had the exclusive privilege of supplying the liquor by wholesale for the entire State of Tamil Nadu. The assessee had also been offering cash discount for early settlement of bills by TASMAC. 6. For the assessment year 1996-97, the assessee was assessed on the files of the revenue on a total turnover of Rs. 2,52,33,32,932/- and Rs. 2,49,65,22,854/- respectively by the assessment order dated 21.10.1998. Thereafter, the Assessing Officer6, by a notice dated 30.04.1999, proposed to levy purchase tax under Section 7-A of the Act on the purchase of empty bottles from unregistered dealers under bought note through salesman permits, on a sum of Rs. 24,78,20,465/- at the rate of 16% with surcharge, additional surcharge as also additional tax at the rate of 2.50%. 6 Hereinafter also referred to as ‘the AO’ In his notice dated 30.04.1999, the AO, inter alia, observed that addition of sub-section (7) to Section 3 with effect from 22.05.1984 specifically treats the containers or packing materials as part of the goods sold or purchased; that there was no doubt that the bottles lost their identity as bottles, which were liable to tax at 10% before filling and they became integral part of the finished goods after filling and attracted liability under the charging Section 3(7) of the Act; and when the bottles became part of the goods, liability under Section 7-A of the Act was definite because, as a part of finished goods used in manufacture, it had not suffered the tax earlier. The AO also observed that in view of decision of this Court in Raj Sheel & Ors. v. State of Andhra Pradesh & Ors.: (1989) 74 STC 379, though the empty bottles were used as packing material and merged with the consideration of the main product, there was no separate sale of these empty bottles purchased from unregistered dealers and hence, such purchase of empty bottles was liable to tax under Section 7-A of the Act, as there was no subsequent taxable event on the sale of the packaging material. In response to the said notice dated 30.04.1999, the assessee submitted its objections on 27.09.1999 to the effect that Section 7-A of the Act for levy of purchase tax was not attracted on the purchase of empty bottles for packing Beer and IMFL and, in any event, the proposed levy of purchase tax was illegal and unjustified in view of the Clarification dated 09.11.1989 issued by the SCCT, that was binding on the revenue as per Section 28-A of the Act. The assessee also placed reliance on the proceedings of the Appellate Assistant Commissioner (CT), Chennai7 with respect to the assessment years 1986-87 to 1988-89 holding that imposition of purchase tax on the purchase of empty bottles was illegal and unjustified. The mainstay of the assessee had been that the empty bottles purchased by it were neither consumed nor used in the manufacture of other goods; that the manufacture of Beer or IMFL was complete much prior to its bottling; that the bottling of Beer or IMFL did not complete the process of manufacture; and that it was also a clear trade practice to sell Beer even in barrels, which itself showed that manufacture of Beer had nothing to do with its subsequent bottling. The PCCT, before passing final orders on the aforesaid notice dated 30.04.1999 by the AO, issued his Clarification dated 27.12.2000 that purchase of empty bottles could not be made liable to be charged under Section 7-A of the Act during the assessment years 1991-92,1993-94, 1994-95 and 1995-96 as the Clarification dated 09.11.1989 was in force at the relevant time. However, the PCCT later on re-examined the issue in light of the decision of Tamil Nadu Taxation Special Tribunal, Chennai8 in the case of Appollo Saline Pharmaceuticals (P) Limited v. State of Tamil Nadu: reported in (2000) 120 STC 493, and stated by his Clarification dated 28.01.2002, in modification of the earlier Clarifications, that the assessee was liable to tax under Section 7-A of the Act for the purchase of empty bottles from unregistered dealers that were used for packing of Beer/IMFL manufactured by it. 7 Hereinafter also referred to as ‘the Appellate Authority’ 8 Hereinafter also referred to as ‘the Tribunal’ Apart from the above, the AO, by his notice dated 05.02.2002, proposed to revise the earlier assessment for the assessment year 1996-97 by disallowing the exemption on cash discount allowed by the assessee to TASMAC and to levy tax on the said cash discount, with surcharge and additional surcharge @ 15% and 5% respectively as also the additional sales tax. In response to this notice dated 05.02.2002, the assessee, by its letter dated 18.03.2002, submitted that any cash or other discount on the price allowed in respect of any sale and any amount refunded in respect of articles returned by customers is not to be included in the turnover. In this regard, the assessee placed reliance on Explanation 2(iii) to Section 2(r) of the Act. After examining the objections of the assessee, the AO, by his order dated 27.03.2002, confirmed the proposal of levying purchase tax @ 16% under Section 7-A of the Act on the bottles purchased from unregistered dealers with surcharge and additional surcharge @ 15% and 5% respectively as also additional sales tax @ 2.5% and penalty, essentially on the grounds that empty bottles were purchased from unregistered dealers; that they had been used as raw materials in manufacture of Beer and IMFL products; and that they had not been sold separately. The AO, in support of his conclusion, relied upon the decision of the Division Bench of Madras High Court in Appollo Saline Pharmaceuticals (P) Limited v. Deputy Commercial Tax Officer and Anr.: (2002) 125 STC 500, which relied upon the decision of this Court in Premier Breweries v. State of Kerala: (1998) 108 STC 598. Further, while overruling the objections in respect of levy of tax on cash discount, the AO confirmed the proposal for disallowing the cash discount allowed to TASMAC while observing that discount was only for early settlement of bills of the Distilleries that was akin to discounting the bills with Banks/Financial Institutions; and though the nomenclature adopted was ‘cash discount’, it was nothing but a commission availed for easy payments which did not fall within the purview of discount and was not deductible. 7. Being aggrieved by the order so passed by the AO, the assessee preferred O.P. No.476 of 2002 before the Tribunal seeking quashing of the order dated 27.03.2002 and directions to the AO to give effect to the Clarifications dated 09.11.1989 and 27.12 .2000. The Tribunal, by its order dated 26.06.2002, while dismissing O.P. No. 476 of 2002, observed that when the latest Clarification dated 28.01.2002 was issued on the basis of view taken by the Tribunal and confirmed by the High Court, the assessee was not entitled to question the proceedings of AO on the basis of the Clarifications issued earlier. It was also observed that the rule applicable for tax on the bottles could be extended to casks and kegs too and, by exclusion of casks and kegs, the tax applicable on bottles alone cannot be set aside or withdrawn. The Tribunal further observed that the decision of the jurisdictional High Court in Associated Pharmaceutical Industries Private Ltd. v. The State of Tamil Nadu: (1986) 63 STC 316 was not applicable as the same was rendered prior to the amendment of Section 7- A(1)(a) of the Act by the Tamil Nadu Act No. 78 of 1986 effective from 01.01.1987; and with insertion of the word “use” by way of amendment, the meaning conveyed by the said section was different from the meaning conveyed earlier. Thus, while proceeding in tune with the Clarification dated 28.01.2002, the Tribunal refused to interfere with the order dated 27.03.2002. 8. Being aggrieved by the Tribunal’s order dated 26.06.2002, the assessee filed the writ petition, being W.P. No. 25081 of 2002, before Madras High Court, seeking a writ of certiorarified mandamus for quashing the proceedings in question while directing the AO to pass fresh orders giving effect to the Clarifications/Circulars dated 09.11.1989 and 27.12.2000. The writ petition so filed by the assessee has been considered and disposed of by the High Court by its impugned order dated 10.09.2004. The following three questions were considered by the High Court in its impugned order dated 10.09.2004: - “(i) Whether the purchase turnover of empty bottles purchased by the petitioner Company, who are engaged in the business of manufacturing Beer and IMFL products, from unregistered dealers for bottling Beer and IMFL manufactured by them, through the bought note to the extent of Rs. 24,78,20,465.00 is attracted for purchase tax under Section 7-A of the Tamil Nadu General Sales Tax Act (for brevity “the Act”)?; (ii) Whether purchase tax is leviable on the purchase turnover of the empty bottles purchased by the petitioner Company to the extent of Rs. 24,78,20,465.00, under Section 7-A of the Act, in spite of the clarifications dated 9.11.1989 and 27.12.2000 issued in favour of the petitioner Company by the Special Commissioner of Commercial Taxes, Chennai, in view of Section 28A of the Act?; and (iii) Whether cash discount on the price offered by the petitioner Company to the TASMAC is taxable in view of explanation 2(iii) to Section 2(r) of the Act?” After taking into consideration the rival contentions and exhaustively dealing with the case law on the subject, the High Court, by applying the law laid down by this Court in Premier Breweries (supra) and Assistant Commissioner (Intelligence) v. Nandanam Construction Co.: (1999) 115 STC 427; and with reference to the amended Section 7-A of the Act and the object of this provision as explained by this Court in the case of The State of Tamil Nadu v. M.K. Kandaswami and Ors.: (1975) 36 STC 191 i.e., to plug the leakage and prevent evasion of tax with respect to purchase of goods, rejected the contention of assessee that the turnover for the purchase of empty bottles did not attract levy of purchase tax under Section 7-A of the Act. The High Court held as follows:- “7.6. Hence, applying the law laid down by the Apex Court in (i) PREMIER BREWERIES v. STATE OF KERALA, [1998] 108 STC 598; and (ii) ASSISTANT COMMISSIONER (INTELLIGENCE) v. NANDANAM CONSTRUCTION CO., [1999] 115 STC 427, which was followed by this Court in APPOLLO SALINE PHARMACEUTICALS (P) LTD., v. DEPUTY COMMERCIAL TAX OFFICER & ANOTHER, [2002] 125 STC 500, and keeping in mind the object of Section 7-A of the Act, as amended, as observed in STATE OF TAMIL NADU v. M.K. KANDASWAMI & OTHERS, [1975] 36 STC 191, viz., to plug the leakage and prevent evasion of tax with respect to purchase of empty bottles purchased from unregistered dealers under the bought note, we reject the contention of Mr. C.Natarjan that the purchase turnover for the purchase of empty bottles from unregistered dealers under the bought note is not attracted for levy of purchase tax under Section 7-A of the Act.” However, with respect to the second question, the High Court, inter alia, observed that the Clarification dated 27.12.2000 gained statutory force in view of Section 28-A of the Act, which was inserted by the amendment with effect from 06.11.1997. Further, while relying on various decisions including that of the Constitution Bench of this Court in the case of Collector of Central Excise, Vadodra v. Dhiren Chemical Industries : (2002) 126 STC 122, it was also observed that even though the Clarification dated 09.11.1989 was executive in nature, the same was binding on the authorities till the concessions given to the assessee under the Clarification were withdrawn prospectively with effect from 28.01.2002; and the revenue could not refuse the benefit of the Clarifications dated 9.11.1989 and 27.12.2000 in respect of purchase tax under Section 7-A of the Act for the assessment year 1996-97. The High Court answered this question in favour of the assessee as follows:- “8.6.10. It is, therefore, clear that even though the clarification dated 9.11.1989 is executive in nature, the same is binding on the authorities till the concessions given to the petitioner under the clarification were withdrawn, which could be done only prospectively, viz., in the instance case, with effect from 28.1.2002, and the revenue could not refuse the benefit of the clarifications dated 9.11.1989 and 27.12.2000 in respect of levy of purchase tax under Section 7-A of the Act for the impugned assessment year 1996-97. 8.7. For all these reasons, we are convinced that even though the purchase turnover with respect to the purchase of empty bottles from the unregistered dealers under bought note can be charged for purchase tax under Section 7-A of the Act, the petitioner is entitled for the benefit of the clarifications dated 9.11.1989 and 27.12.2000 till the same is withdrawn prospectively by the clarification dated 28.1.2002 and therefore, the impugned levy of purchase tax on the purchase turnover for the purchase of empty bottles from unregistered dealers under Section 7-A of the Act is illegal.” Lastly, with respect to the third question, the High Court, while relying on various decisions including that of this Court in Neyveli Lignite Corporation Ltd. v. Commercial Tax Officer, Cuddalore and Anr.: (2001) 124 STC 586, took the view that as per Explanation 2(iii) to Section 2(r) of the Act, cash or other discount on the price of goods sold cannot be included in the turnover for the levy of tax. Accordingly, this question was also answered in favour of the assessee and against the revenue as follows:- “9.4. In NEYVELI LIGNITE CORPORATION LTD. v. C.T.O., [2001] 124 STC 586, it was held that it is that sale consideration, whether in cash or otherwise, which is receivable in respect of sales made by the dealer which can possibly form part of the turnover of a dealer. 9.5. From the law as enunciated from the decisions referred supra, we are convinced that in view of explanation 2(iii) to Section 2(r) of the Act, the cash or other discount on the price of goods sold cannot be included in the turnover for levy of tax.” Therefore, the High Court, particularly in view of its answers to question Nos. (ii) and (iii) as above, allowed the writ petition filed by the assessee. 9. Being aggrieved by the order dated 10.09.2004 so passed by the High Court in W.P. 25081 of 2002, the revenue has filed the appeal by special leave, being Civil Appeal No. 7164 of 2013 questioning the grant of relief to the assessee. On the other hand, the assessee has also filed the appeal by special leave, being Civil Appeal No. 7165 of 2013, against this very order insofar as the High Court has decided the principal question relating to the applicability of Section 7-A of the Act against it. Rival Submissions The Assessee 10. As regards the question as to whether the purchase turnover of empty bottles purchased from unregistered dealers is exigible to purchase tax, the learned senior counsel for the assessee has submitted that the question of levy of purchase tax on this purchase turnover does not arise while making elaborate reference to the object and scheme of Section 7-A of the Tamil Nadu Act; to the process of bottling of Beer/IMLF after the same had been manufactured; and to the fact that the sale of liquor with bottles had only been to TASMAC within the State of Tamil Nadu with bottles being also taxed on such sales. The learned senior counsel has referred to the history of insertion of Section 7-A to the Tamil Nadu Act w.e.f. 27.11.1969 and its various amendments from time to time with the submissions that the said provision was inserted with the main object to plug the leakage and to prevent evasion of tax. Further, with reference to the provisions contained in Section 7-A as applicable at the relevant time and sub-sections (1), (7) and (8) of Section 3 of the Act, the learned senior counsel has contended that the bottles were not disposed of “in any manner other than by way of sale in the State” but these were disposed of only by way of sale to TASMAC within the State of Tamil Nadu itself on payment of sales tax and hence, clause (b) of Section 7-A(1) does not apply. In support of these contentions, the learned senior counsel has relied upon the decision of this Court in the case of Hotel Balaji and Ors. v. State of Andhra Pradesh and Ors.: (1993) 88 STC 98, more particularly on the observations occurring in a few paragraphs of said decision in relation to the provisions contained in the Haryana General Sales Tax Act, 1973.9 The learned senior counsel has also contended that the revenue itself had accepted such factual and legal decision and has issued Clarifications/Circulars dated 09.11.1989 and 27.12.2000 realising that since the sale value of bottles is subject to tax at the time of sale of the contents, it has no liability to tax under Section 7-A of the Act. Taking up clause (a) of sub-section (1) of Section 7-A of the Act, the learned senior counsel has submitted that the language used in the said clause (a) has been ‘consumes or uses such goods in the manufacture of other goods for sale or otherwise’. Thus, according to the learned counsel, what is to be seen is whether bottles were consumed or used in the manufacture of liquor; and as per the said language used in clause (a), it cannot apply to the present case either textually or contextually because Beer/IMFL was fully manufactured and such fully manufactured liquor was transferred to the bottling section; that bottles have got their own identity and they remained bottles at all stages, i.e., before being used for filling the liquor, after being used for this purpose, after liquor was consumed by the consumers, and even when these were cleaned and re-used by the assessee; and that the character and identity of bottles as bottles was never lost, they were capable of repeated use, and the assessee was cleaning and re-using such bottles. The learned senior counsel has referred to the Tamil Nadu Brewery Rules, 1983 and the Tamil Nadu Indian Made Foreign Spirits (Manufacture) Rules, 1981 to 9 Hereinafter also referred to as ‘the Haryana Act’. submit that it is manufactured Beer/IMFL, which is filled in bottles in a separate bottling section and, so far as the manufacture of Beer/IMFL is concerned, the same had already taken place before bottling and hence, bottles are not ‘consumed or used in the manufacture’ of liquor for sale. The learned senior counsel has also referred to the decision of this Court in the case of State of Uttar Pradesh and Ors. v. Mohan Meakin Breweries Ltd. and Anr.: (2011) 13 SCC 588 to submit and re-emphasize that process of bottling commences only after completion of manufacturing of Beer when bulk Beer is transferred from the brewery for bottling; and manufacturing of liquor and putting manufactured commodity into bottles being two different processes, it cannot be said that the bottles have been consumed or used in manufacture of other goods. The learned senior counsel has emphatically contended that in the process of manufacture, conversion of one commodity into a different commodity remains the essential element and if the identity of goods is not changed with irreversible process, manufacture would not be deemed to have taken place. In this regard, the learned counsel has referred to various decisions including those in Mafatlal Industries Ltd. v. Nadiad Nagar Palika and Anr.: (2000) 3 SCC 1, HMM Limited and Anr. v. Administrator, Bangalore City Corporation, Bangalore and Anr.: (1989) 4 SCC 640, Punjab Aromatics v. State of Kerala: (2008) 11 SCC 482, Collector of Central Excise, Bombay-II v. M/s. Kiran Spinning Mills: (1988) 2 SCC 348, Commissioner of Central Excise & Customs, Gujarat v. Pan Pipes Resplendents Ltd. : (2006) 1 SCC 777, Union of India v. Alembic Glass Industries Ltd.: (2010) 11 SCC 745, Ganesh Trading Co., Karnal v. State of Haryana and Anr.: (1973) 32 STC 623, Burmah Shell Oil Storage and Distributing Co. of India Ltd., Belgaum v. Belgaum Borough Municipality: AIR 1963 SC 906, and Kathiawar Industries Ltd. v. Jaffrabad Municipality: (1979) 4 SCC 56. Again, with reference to the decision in Hotel Balaji (supra), the learned senior counsel would contend that the provisions as contained in the Haryana Act carried the same language i.e., ‘uses them in the State in the manufacture of goods’; and per the enunciation in the said decision, the provision for levy of purchase tax would apply only to those cases where the purchased goods ‘cease to exist as such goods for the reason that they are consumed in manufacture of different commodities’ or the purchased goods ‘are put to an end by their consumption in the manufacture of other goods’; and no such event having taken place where the goods in question (the bottles) had ceased to exist or had been put to an end by consumption in the manufacture of other goods, the question of levy of purchase tax does not arise. The learned senior counsel has also submitted that during the period involved in the present case, i.e., from 01.04.1996 to 31.03.1997, the requirement for applicability of clause (a) of Section 7-A(1) was stated in the manner that dealer ‘consumes or uses such goods in the manufacture of other goods for sale or otherwise’; and the scope of clause (a) was subsequently widened w.e.f. 06.11.1997 when new clause (a) was substituted by the Tamil Nadu General Sales Tax (Sixth Amendment) Act 1997 to read as ‘consumes or uses such goods in or for the manufacture of other goods for sale or otherwise’ but, during the period relevant for the present case, the expression “or for” was not there in the statute. According to the learned counsel, when Beer/IMFL had already been manufactured before bottling, the bottles were neither consumed nor used in manufacture of the contents; and nothing turns upon the expressions “consumes” or “uses” inasmuch as in both the situations, such consumption or use was required to be ‘in the manufacture of other goods’, which is not the case here. As regards the decisions referred to in the impugned orders, the learned senior counsel for the assessee has submitted that the said decisions do not operate against the contentions of the assessee. The learned senior counsel would submit that in the case of M. K. Kandaswami (supra), this Court had only analysed the scheme of Section 7-A of the Act, as then existing, and had pointed out that the said provision was itself a charging provision. As regards the decision in the case of Nandanam Construction Co. (supra), the learned counsel would contend that therein, the respondent was purchasing goods such as sand and bricks which were consumed in the construction of flats and hence, this Court held that when the goods ceased to exist in the original form or ceased to be available in the State for sale or purchase, the purchasing dealer of such goods would be liable to tax, if the seller is not or cannot be taxed. The decision in Premium Breweries (supra), has been distinguished by the learned counsel with the submissions that therein, contention of the dealer was that the cardboard cartons, in which the liquor bottles were packed, may not be taxed at the higher rate applicable to the sale of liquor because cardboard cartons were sold separately but such a contention was not accepted by this Court. Thus, according to the learned counsel, for different fact situation and different question being involved, the said decision has no application to the present case. As regards the decision of Madras High Court in the case of Appollo Saline Pharmaceuticals (supra), the learned senior counsel has strenuously argued that the said decision is not correct in law and is even otherwise distinguishable. The learned counsel has pointed out that the goods in question in the said decision were the bottles carrying ‘intravenous fluid’10 which had different role in the process of manufacture of I.V. fluid as also in the peculiar process of intravenous route of administration, where the fluid is given from a bag connected to a thin tube inserted into the veins; and it is important to keep a check on the rate of flow and delivery by continuous monitoring. The learned counsel would submit that by its very nature, where the manufacture of I.V. fluid requires its particular packing, the said packing does not retain its identity and becomes a part of the composite unit called I.V. fluid; that packing of I.V. fluid in bottle is one time packing and after I.V. fluid is taken out, the packing becomes useless and is discarded; and that in the said decision itself, the entire I.V. fluid contained in bottle was considered to be a composite unit, which is not the case in relation to the bottles used as container of Beer/IMFL. 10 ‘I.V. fluid’ for short The learned senior counsel has further submitted that the phraseology considered in the matter of Appollo Saline Pharmaceuticals (supra) was ‘in or for the manufacture’, which was the position obtainable after the amendment of Section 7-A of the Act w.e.f. 06.11.1997 whereby, the expression “or for” was inserted in clause (a) thereof but, that was not the position during the period involved in the present case. The learned counsel has also submitted that in the said matter, the High Court did not even consider the relevant decisions of this Court wherein the relevant expressions have been considered and interpreted by this Court including that in the case of Hotel Balaji (supra) wherein, according to the learned counsel, this Court had considered the provisions of Haryana Act which are in pari materia with the provisions of the Tamil Nadu Act in relation to the levy of purchase tax. The learned counsel has further submitted that in Appollo Saline Pharmaceuticals (supra), reference was only made to decision of this Court in the case of J.K. Cotton Spinning & Weaving Mills Co. Ltd. v. Sales Tax Officer, Kanpur and Ors.: (1965) 16 STC 563 though the issue involved in the said matter was completely different and related to categories of goods to be included in the registration certificate which has no co-relation with levy of purchase tax, particularly in view of the language used in Section 7-A(1) (a) of the Act. 11. As regards the Clarifications/Circulars, the learned senior counsel has referred to the contents of the Clarifications dated 09.11.1989 and 27.12.2000 and has made the submissions that in the assessee’s own case, after examining the relevant facts and legal position, the revenue had specifically clarified that since the sale value of bottles is subject to tax at the time of sale of the contents, it had no liability to tax under Section 7-A of the Act; and such clarifications remain binding on the revenue, as rightly held by the High Court. Further, with reference to the decisions of this Court in the cases of Commissioner of Income Tax, Kochi v. Trans Asian Shipping Services (P) Ltd.: (2016) 8 SCC 604, Signode India Ltd. v. Commissioner of Central Excise & Customs-II: (2017) 4 SCC 613, State of Tamil Nadu and Anr. v. India Cements Limited and Anr.: (2011) 13 SCC 247 and Commissioner of Central Excise, Bolpur v. Ratan Melting & Wire Industries: (2008) 13 SCC 1, the learned senior counsel has submitted that the law remains settled that the Circular granting benefit to the assessee is binding on the department. Thus, according to the learned counsel, the High Court has rightly applied the principles of such decisions while holding that the benefit of Clarifications dated 09.11.1989 and 27.12.2000 cannot be denied to the assessee. While making reference to the Clarification dated 28.01.2002, which was issued after the Tribunal’s decision in the case of Appollo Saline Pharmaceuticals, the learned senior counsel has contended that therein, the earlier Clarification dated 27.12.2000, clarifying that in the facts and circumstances of the present case, no purchase tax was payable under Section 7-A of the Act, was neither withdrawn nor cancelled and on the other hand, the expression used in the new Clarification, of modification, makes it clear that the new one was made effective only prospectively and hence, cannot apply for the period in question. In this regard too, the learned senior counsel has referred to and relied upon various decisions including those in H.M. Bags Manufacturer v. CCE: 1997 (94) ELT 3 and Commissioner of Customs, Mumbai v. Ashish Bajpai: 2007 (217) ELT 163. The revenue 12. The learned Additional Advocate General appearing for the revenue has countered the submissions made on behalf of the assessee while again making elaborate reference to the object and scheme of Section 7-A of the Tamil Nadu Act as also its interpretation and application in various decisions. It has been argued on behalf of the revenue that the amendment to Section 7-A of the Act and addition of the words “or uses” in clause (a) thereof had broaden the scope of this provision as also the jurisdiction of assessing authorities to levy purchase tax on any commodity, which had not suffered tax earlier and which has been used in the process of manufacturing any good to be sold. Therefore, the assessee is liable to pay purchase tax under Section 7- A of the Act because the bottles purchased from unregistered dealers were not taxed at the purchase point and charging of such purchase tax does not amount to double taxation. The learned AAG has referred to the decision in M.K. Kandaswami (supra) to submit that therein, this Court has made it clear that Section 7-A of the Act is a charging section and has explained that Section 7-A of the Act deals with “taxable goods”, that is, the kind of goods, the sale of which by a particular person or dealer may not be taxable in the hands of seller but purchase of the same by a dealer in the course of his business may subsequently become taxable. Thus, Section 7-A of the Act creates a liability against a dealer on his purchase turnover of goods, the sale or purchase of which though generally liable to tax under the Act, have not suffered tax and which, after the purchase, have been dealt by him in any of the modes indicated in Section 7-A(1). The learned AAG has further argued, with reference to the decision in Premier Breweries (supra), that the calculation of taxable turnover cannot be accomplished without taking into consideration the purchase tax on the goods purchased; and this Court has held that the packed goods have to be seen as one whole for the purpose of calculating the turnover of the goods. While relying on the decision of the High Court in Appollo Saline Pharmaceuticals (supra), the learned AAG has pointed out that therein, the Court has held that the turnover of bottles would be part of the turnover of the I.V. fluid because the bottles were not sold individually but as a composite unit of I.V. fluid packed in bottles. It has been contended that on similar lines and analogy, packaging of Beer/IMFL in glass bottles has to be seen as an inseparable composite unit, particularly when the containers are needed to make the goods marketable. Reference has also been made to the decision of this Court in J.K. Cotton (supra) wherein, it was held that the expression “in the manufacture of goods” in sub-section 8(3)(b) of the Central Sales Tax Act should encompass the entire process carried on by the dealer of converting raw materials into finished goods. It has also been contended that levy of sales tax on the bottles sold with liquor has no bearing on the question of levy of purchase tax because such sales tax on bottles was leviable even if the bottles were purchased from registered dealers or in any other manner after payment of tax. Further, while placing reliance on the Tamil Nadu Indian Made Foreign Spirits (Manufacture) Rules, 1981 the learned AAG has submitted that the use of bottle is imperative in the manufacture of Beer/IMFL as per the rules and guidelines because the product needs resting and proper storing before it is fit to be sold. In regard to Beer bottle, several of its unique characteristics have been recounted on behalf of revenue to submit that the same would identify it only as Beer bottle and nothing else, for example, (i) the thickness of the glass used in the Beer bottle; (ii) the colour of the glass of the bottle, which is a quality attached to specific brands; (iii) the grooves on the neck of the bottle, which are made only for an aluminium cap and not for any other covering, thereby making the bottle fit only for refilling of Beer; and (iv) the length, width, breadth, etc. of the bottle, which is specific to every Beer brand. The learned AAG for revenue has further relied upon the interpretation of Section 6-A(ii)(a) of the Andhra Pradesh General Sales Tax Act, 195711 by the Constitution Bench of this Court in the case of Nandanam Construction Co. (supra) with the submissions that the said provision has been in pari materia with Section 7-A(1)(a) of the Tamil Nadu Act and this Court held that, when the goods cease to exist in the original form or cease to be available in the State for sale or purchase, the purchasing dealer of such 11 Hereinafter also referred to as ‘the Andhra Pradesh Act’. goods is liable to tax if the seller is not or cannot be taxed. The learned AAG has further relied upon the interpretation and application of Section 7 of the Madhya Pradesh General Sales Tax Act, 195912 by this Court in the case of Ganesh Prasad Dixit v. Commissioner of Sales Tax, Madhya Pradesh: (1969) 24 STC 343 with the submissions that the said provision has also been in pari materia with Section 7-A(1)(a) of the Tamil Nadu Act and this Court held that the assessees were registered as dealers and when they had purchased taxable building materials in the course of their business for manufacturing goods for sale, purchase tax was payable by them. 13. As regards the questions relating to the Clarifications/Circulars, the learned AAG has submitted that Section 28-A of the Act empowering the Commissioner of Commercial Taxes to issue clarifications came into effect from 06.11.1997 and hence, during the relevant assessment year i.e. 1996-97, there was no statutory provision in the Act empowering the Commissioner to issue the clarification. Thus, according to the learned AAG, the earlier Clarification dated 09.11.1989 was reduced to a mere administrative circular which had no binding force on a Quasi-judicial Authority or a Court of Law and as a consequence, the Clarification dated 27.12.2000, which was issued in continuity with the earlier Clarification dated 09.11.1989, cannot be made applicable for the assessment year 1996-97. The learned AAG has also relied upon the Constitution Bench decision in Ratan Melting & Wire Industries (supra) with the submission that while dealing with any matter, the Courts can declare law, fill any gaps in 12 Hereinafter also referred to as the ‘Madhya Pradesh Act’. legislation or give an interpretation to an already existing law; and the law so declared remains binding on all. Insofar as this matter is concerned, according to the learned AAG, the law came to be declared by this Court in Premier Breweries (supra) that the packed goods have to be seen as one whole for the purpose of calculating the turnover; and on similar lines, in Appollo Saline Pharmaceuticals (supra), the High Court held that an assessee paying purchase tax will not suffer any additional burden because any other manufacturer who had bought the bottles from registered dealers would also be including their cost in the turnover of final goods. According to the learned AAG, a natural development of the decisions by the Courts had been that the Clarifications dated 09.11.1989 and 27.11.2000 became contrary to the law declared; and it had been in this background that the Clarification dated 28.01.2002 came to be issued. The learned AAG would submit that the interpretation given by the High Court of Madras in Appollo Saline Pharmaceuticals (supra), which is in line with the law declared by this Court in Premier Breweries (supra), gave clarity to the application of Section 7-A of the Act and hence, to give effect to the real meaning of Section 7-A of the Act, the Clarification dated 28.01.2002 ought to be considered applicable because the law as declared would apply across the board and not only prospectively. 14. We may notice another ground taken by the revenue in the petition seeking leave to appeal that the High Court has erred in holding that the so- called ‘cash discount’ falls under the ambit of Explanation (2)(iii) of Section 2(r) of the Act and therefore, exemption is to be allowed thereupon. The Points for Determination 15. In comprehension of what has been noticed hereinabove, the principal point calling for determination in these appeals is as to whether purchase tax under Section 7-A of the Act is leviable on the purchase turnover of empty bottles purchased by the assessee in the course of its business of manufacture and sale of Beer and IMFL. The second point, co-related with the principal one, is on the operation and effect of the Clarifications/Circulars dated 09.11.1989, 27.12.2000 and 28.01.2002 as issued by the department. Another point arising out of the impugned order dated 10.09.2004 is as to whether cash discount on the price offered by the assessee to the TASMAC is taxable in view of Explanation 2(iii) to Section 2(r) of the Act? The Principal Point: Purchase Tax under S. 7-A of the Act over the Turnover in Question 16. Taking up the principal point for determination, we may usefully put in a nutshell the major aspects of the rival contentions. It is asserted on behalf of the assessee that purchase tax on the turnover in question is not leviable for two main reasons: One, that the bottles in question had not been consumed or used in the manufacture of liquor and they were only used as containers in which already manufactured liquor was bottled for carrying and sale; and secondly, the sale value of bottles has been subjected to tax at the time of sale of its contents and therefore, there could arise no question of levy of purchase tax on these very bottles, which are meant for repeated use. Per contra, it is contended on behalf of the revenue that use of bottles is imperative in the manufacture of Beer/IMFL and their packaging in glass bottles has to be seen as an inseparable composite unit; and that levy of sales tax on the bottles sold with liquor has no bearing on the question at hand because such sales tax on bottles was leviable even if the bottles were purchased after payment of tax. Statutory Provisions 17. Having regard to the subject-matter and the questions involved, appropriate it would be to take note of the relevant statutory provisions in the Tamil Nadu Act. Sub-sections (1), (7) and (8) of Section 3 of the Tamil Nadu Act, being the principal charging provision for levy of sales tax, read at the relevant time as under:- “3. Levy of taxes on sales or purchases of goods (1) Every dealer (other than a casual trader or agent of a non- resident dealer) whose total turnover for a year exceeds three lakhs of rupees and every casual trader or agent of a non- resident dealer, whatever be his turnover for the year, shall pay a tax for each year in accordance with the provisions of this Act. * * * (7) Notwithstanding anything contained in sub-sections (2), (2A), (2B) or (3) but subject to sub-sections (1) and (8), where goods are sold or purchased together with the containers or packing materials the turnover of such goods shall include the price, cost or value of such containers or packing materials, and the packing charges, whether such price, cost or value or packing charges, are charged separately or not, and tax shall be levied thereon at the rate applicable to the goods contained or packed as if such containers or packing materials were the parts of the goods sold or purchased. (8) Where the sale or purchase of goods contained in any container or packed in any packing material is exempt from tax at the hands of the dealer, then the price, cost or value of such container or packing material and the charges for packing forming part of the turnover of the goods under sub-section (7) shall not be liable to tax. Explanation: For the purposes of sub-sections (7) and (8), “containers” includes gunny bags, tins, bottles or any other containers.” As noticed, Section 7-A was inserted in the Tamil Nadu Act with effect from 27.11.1969. This provision has undergone several amendments from time to time but, for the present purpose, its sub-section (1), as examined by this Court in the judgment dated 15.07.1975 in the case of M.K. Kandaswami (supra) and then, as applicable to the present case pertaining to the assessment year 1996-97, may be noticed. The relevant part of the provision contained in Section 7-A (1) of the Act, as interpreted in the case of M.K. Kandaswami (supra), was as under (at p. 195 of STC):- “Section 7-A. Levy of purchase tax: (1) Every dealer who in the course of his business purchases from a registered dealer or from any other person, any goods (the sale or purchase of which is liable to tax under this Act) in circumstances in which no tax is payable under sections 3, 4 or 5, as the case may be, and either,— (a) consumes such goods in the manufacture of other goods for sale or otherwise; or (b) disposes of such goods in any manner other than by way of sale in the State; or (c) despatches them to a place outside the State except as a direct result of sale or purchase in the course of inter-State trade or commerce, shall pay tax on the turnover relating to the purchase aforesaid at the rate mentioned in sections 3, 4 or 5 as the case may be whatever be the quantum of such turnover in a year: Provided that a dealer (other than a casual trader or agent of a non-resident dealer) purchasing goods (the sale of which is liable to tax under sub-section (1) of section 3) shall not be liable to pay tax under this sub-section, if his total turnover for a year is less than twenty-five thousand rupees. * * *” A few significant amendments were made to the provision aforesaid by Tamil Nadu Act No. 78 of 1986 with effect from 01.01.1987 whereby, amongst other changes, the dimensions of its applicability were modified in the principal part and then, a significant change was made in clause (a) where, after the word “consumes”, the words “or uses” were inserted. Then, some further amendments were made to this provision by Tamil Nadu Act No. 25 of 1993 with effect from 12.03.1993. With such amendments and modifications, Section 7-A (1) of the Act, as applicable to the present case, has been as under:- “Section 7-A. Levy of purchase tax: (1) Subject to the provisions of sub-section (1) of section 3, every dealer who in the course of his business purchases from a registered dealer or from any other person, any goods, (the sale or purchase of which is liable to tax under this Act) in circumstances in which no tax is payable under sections 3 or 4, as the case may be, not being a circumstance in which goods liable to tax under sub-section (2) of section 3 or section 4, were purchased at a point other than the taxable point specified in the First or the Second Schedule and either, (a) consumes or uses such goods in the manufacture of other goods for sale or otherwise; or (b) disposes of such goods in any manner other than by way of sale in the State; or (c) despatches or carries them to a place outside the State except as a direct result of sale or purchase in the course of inter-State trade or commerce, shall pay tax on the turnover relating to the purchase as aforesaid at the rate mentioned in sections 3 or 4, as the case may be.” Another aspect of amendment to the provision aforesaid by Tamil Nadu Act No. 60 of 1997 w.e.f. 06.11.1997 may also be taken note of with a caveat that this amendment is not directly applicable to the present case pertaining to the assessment year 1996-97 but has its relevance in relation to one limb of submissions made before us. By this amendment, in clause (a) of Section 7-A (1) of the Act, after the expression “in”, the words “or for” were inserted, resulting in further widening of the area of coverage of this provision. For its relevance, we may extract in juxtaposition the progression of this clause (a) of Section 7-A (1) of the Act i.e., as originally enacted; as applicable to the present case after its amendment w.e.f. 01.01.1987; and as amended further w.e.f. 06.11.1997 as follows:- Clause (a) of Section 7-A (1) as originally enacted Clause (a) of Section 7-A (1) as applicable to the present case after its amendment w.e.f. 01.01.1987 Clause (a) of Section 7-A (1) as amended w.e.f. 06.11.1997 “(a) consumes such “(a) consumes or uses “(a) consumes or uses goods in the such goods in the such goods in or for manufacture of other manufacture of other the manufacture of goods for sale or goods for sale or other goods for sale or otherwise; or”. otherwise; or”. otherwise; or”. மேலும் ஒரு இரட்டை மேல்முறையீட்டு மனுக்களை வரிவிதிப்புக்குள்ளானவர் சமர்ப்பித்திருக்கிறார் 3. சுருங்கக்கூறினால், இந்தவிஷயங்களில் மதுபானங்கள் பீர் மற்றும் இந்தியன் மேட் பாரின் லிக்கர்2 ஆகியவற்றின் உற்பத்தி மற்றும் விற்பனையில் ஈடுபடும் ஒரு வரிவிதிக்கப்படுபவர், அவரது வணிக நடவடிக்கைகளின் போது மேற்கொண்ட காலி புட்டிக்களின் கொள்முதல் விற்பனை அளவு மீதான வரிவிதிப்பா மற்றும் சிறப்பு ஆணையர் மற்றும் சென்னை வணிக வரி ஆணையர்3 வெளியிட்ட 09.11.1989 தேதியிட்ட விளக்க அறிக்கை மற்றும் தலைமை ஆணையர் மற்றும் சென்னை வணிக வரி ஆணையர்4 வெளியிட்ட 27.12.2000 தேதியிட்ட விளக்க அறிக்கைகளின் செயலாக்கம் மற்றும் விளைவுகளோடு கூடிய வரி விதிப்பா என்ற அடிப்படை கேள்விகளோடு சில சந்தர்ப்பங்களின் கீழ் கொள்முதல் வரிவிதிப்பு மேற்கொள்ளப்படவேண்டியது குறித்து தமிழ்நாடு சட்டம் பிரிவு 7 இன் பொருள்விளக்கத்தை பகுத்துப்பார்க்கப்பட்ட வேண்டியவைகளாக இந்த விஷயங்கள் இருக்கின்றன. அதற்கு இணையாக அந்த சட்டத்தின் பிரிவு 2(iii) லிருந்து பிரிவு 2 (r) வரையிலான பிரிவுகளின் படியான விளக்கத்தின் அடிப்படையில் தமிழ்நாடு ஸ்டேட் மார்க்கெட்டிங் கார்போரேஷன் லிம்ட்டட்5 டுக்கு வரிவிதிக்கப்படுபவர் விலையில் அளித்த ரொக்கப் தள்ளுபடித் தொகையும் வரிவிதிப்புக்குள்ளாக்கப்பட்டுமா? என்ற கேள்வியும் தொக்கி நிற்கிறது. 4. வரி வருவாய்துறை மற்றும் வரிவிதிப்புக்குள்ளானவர் ஆகிய இருவருமே தங்களது உரிமையியல் மேல்முறையீட்டு மனு எண்கள் 7164 of 2013 மற்றும் 7165 of 2013 ஆகியவற்றின் மூலமாக உயர்நீதிமன்றம் முன்னர் அளித்த 10.09.2004 தேதியிட்ட உத்திரவை எதிர்த்து அளித்த மனுக்கள் மீதான உத்திரவின் அடிப்படையிலேயே உரிமையியல் மேல்முறையீட்டு மனு எண்கள் 4416-4419 of 2014 மீதான 05.12.2013 தேதியிட்ட மறுத்துரைக்கப்பட்ட ஆணையானது அமைந்துள்ளது தெரியவருகிறது. ஆகவே, 10.09.2004 தேதியிட்ட உத்திரவுக்கு எதிரான எதிர்மேல்முறையீடுகளில் அத்தியாவசிய தேவையான தகவல்கள் வழியாக இதை கையாள நாங்கள் முன்மொழிகிறோம். உரிமையியல் மேர்முறையீட்டு எண்கள் 7164 மற்றும் மற்றும் ஐஎம்எஃப்எல் உற்பத்தி வணிகத்தில் ஈடுபட்டுவருகிறார்கள். வணிகவரி அதிகாரி போரூர் வரிவிதிப்பு வட்ட அலுவலகத்திலுள்ள கோப்புக்களில் ஓர் வரிவிதிக்கப்படுபவராக பதிவு செய்யப்பட்டிருக்கிறார். 5.1 வரி விதிக்கப்படுபவர், மதுபானங்கள் பீர் மற்றும் ஐஎம்எஃப்எல் உற்பத்தி மற்றும் மதுபானங்கள் பீர் மற்றும் ஐஎம்எஃப்எல்லை புட்டிக்களில் அடைக்கும் வணிக தேவைக்காக காலி பூட்டிகளை மாநிலத்திற்கு வெளியே அமைந்த பதிவு பெறாத விற்பனையாளர்களிடமிருந்தும் அத்துடன் விற்பனையாளர்கள் அல்லாதவர்களிடமிருந்தும் கொள்முதல் செய்திருக்கிறார். அந்த புட்டிகள் நுகவோர் பயன்பாட்டிற்குப் பிறகு மறுசுழற்சி செய்யப்பட்டு பீர் மற்றும் ஐஎம்எஃப்எல் நிரப்பப்படுவதற்கானவை என்பதே வரிவிதிக்கப்படுபவரின் வாதம். பீர் உற்பத்தி செலவு ஒரு பெட்டிக்கு ரூ. 109.93 என்ற நிலையில் ஒரு பெட்டி புட்டிக்களின் விலை ரூ. 35.69 என்பதாகும், அது உற்பத்தி செலவில் புட்டிக்களின் பங்கு 32% வகிக்கிறது . ஐஎம்எஃப்எல்லைப் பொறுத்தவரையில், ஒரு பெட்டிக்கு அதன் தயாரிப்பு விலையான ரூ. 217.06 என்பதற்கு எதிராக ஒரு பெட்டி காலி புட்டிகள் விலை ரூ.60.40 என்று அதன் உற்பத்தி செலவில் 28% பங்கு வகிக்கிறது. வரிவிதிக்கப்படுபவரின் கூற்றுப்படி கொள்முதல் சீட்டு மூலம் வாங்கப்பட்ட இந்த புட்டிகள் ஏற்கனவே நிரப்பப்பட்டு ஒரு குறிப்பிட்ட விலைக்கு விற்கப்பட்டு பயன்படுத்தப்பட்டவை மற்றும் அவைகள் மீள் பயன்பாட்டிற்கும் வணிகம் செய்யப்படுவதற்காகவும் தொடர்ந்து கிடைக்கின்றன. 5.2. மேலும் வரிவிதிக்கப்படுபவரின் கூற்றுப்படி, தமிழ்நாடு சாராய ஆலைச்சட்டங்கள் 1983 விதிப்பிரிவு 29 இன் கீழ் பீர் மதுபானங்களை புட்டிகள் அல்லது பீப்பாய்கள் அல்லது குடுவைகளிலும் கூட நிரப்பும் விருப்பத்தேர்வு அவருக்கு இருக்கிறது; வரிவிதிக்கப்படுபவர் தயாரிக்கும் பீர் மற்றும் ஐஎம்எஃப்எல் மதுபானங்கள் முழுவதுமாக, தமிழ்நாடு மாநிலம் முற்றிலும் மொத்தவிற்பனை செய்யும் தனிச்சிறப்புரிமை பெற்ற டாஸ்மாக்(TASMAC) நிறுவனத்திற்கு மட்டுமே விற்கப்படுகிறது. மேலும் வரிவிதிக்கப்படுபவர், TASMAC விலைப்பட்டியல் தொகையை விரைவில் வழங்கி தீர்வு செய்வதற்கு விலையில் ரொக்க தள்ளுபடி சலுகையையும் அளித்து வருகிறது. 6. 1996 -97 ஆம் வரிவிதிப்பு ஆண்டுக்கு, வரி வருவாய்த்துறை கோப்புகளின் படி முறையே ரூ. 2,52,33,32,932 மற்றும் ரூ. 2,,49,65,22,854 என்ற மொத்த விற்பனை தொகை மீது 21.10.1998 தேதியிட்ட வரிவிதிப்பு உத்திரவு மூலம் மதிப்பீடு செய்யப்பட்டு வரிவிதிக்கப்படுபவருக்கு வரி விதிக்கப்பட்டிருக்கிறது. அதன் பிறகு பதிவு பெறாத விற்பனையாளர்களிடமிருந்து விற்பனை பணியாளரின் உரிமம் மூலமாக கொள்முதல் சீட்டின் கீழ் காலிப் புட்டிகள் வாங்கிய தொகையான ரூ. 24,78,20,465/- க்கு 16% என்ற விகிதத்தில் உபரிவரி, கூடுதல் உபரி வரி மற்றும் 2.50% என்ற விகிதத்தில் கூடுதல் வட்டியையும் சேர்த்து சட்டப்பிரிவு 7Aஇன் கீழ் கொள்முதல் வரி விதிப்பதற்கான முன்மொழிவை 30.04.1999 தேதியிட்ட அறிக்கையை வரிவிதிப்பு அதிகாரி6 வழங்கினார். 6.1 AO ஆனவர் 30.04.1999 தேதியிட்ட அவரது அறிவிப்பில், மற்றவற்றுக்கிடையில், 22.05.1984 தேதியிலிருந்து அமலிலுள்ள விதிப்பிரிவு 3 இன் கூடுதலாக இணைக்கப்பட துணைப்பிரிவு (7) குறிப்பாக, கொள்கலங்கள் அல்லது கட்டுப்பொருட்களை விற்பனை செய்யப்பட்ட அல்லது கொள்முதல் செய்யப்பட்டவைகளின் ஒருபகுதியாக வரையறுக்கிறது என்ற கருத்தை தெரிவிக்கிறார். நிரப்பப்படுவதற்கு முன் 10% வரிவிதிப்புக்கு உள்ளாகவேண்டிய அந்தப் புட்டிகள் தங்களது அடையாளத்தை இழந்துவிடுகின்றன மற்றும் நிரப்பப்பட்ட பிறகு அவை நிறைவடைந்த உற்பத்திப் பொருட்களின் ஒரு அங்கமாக மாறி சட்டத்தின் வரிவிதிப்பு பிரிவுகள் 3(7) இன் கீழ் வரிவிதிப்பிற்கான தகுதியை பெறுகின்றன. மற்றும் அந்த புட்டிகள் முன்னர் எந்த விதமான வரிவிதிப்புக்கு உள்ளாகாத நிலையில் உற்பத்தியின் போது பயன்படுத்தப்பட்டு நிறைவடைந்த உற்பத்தி பொருட்களின் ஒரு அங்கமாக மாறுகையில் சட்டபிரிவு 7-A இன் கீழ் வரிவிதிப்புக்கு உள்ளாகவேண்டியது கட்டாயமாகிறது என்பதில் எந்த ஒரு சந்தேகமும் இல்லை. ராஜ் ஷீல் & மற்றவர்கள் (எதிர்) ஆந்திரப்பிரதேச அரசு & மற்றவர்கள் :(1989) 74 STC 379 ஆகியோருக்கிடையிலான வழக்கில் காலி புட்டிகள் தயாரிப்புப்பொருளுடன் இணைந்து பேக்கிங் பொருட்களாக பயன்படுத்தப்பட்டு இருந்தாலும், பதிவு பெறாத விற்பனையாளர்களிடமிருந்து கொள்முதல் செய்யப்பட்ட இந்த காலி புட்டிகளுக்கு வேறு தனிப்பட்ட விற்பனை எதுவும் இல்லாத மற்றும் அதைத் தொடர்ந்து பேக்கிங் பொருட்கள் மீது வரிவிதிக்கப்படவேண்டிய நிகழ்வுகள் எதுவும் இல்லை என்ற காரணத்தால் அம்மாதிரி கொள்முதல் செய்யப்பட்ட காலி புட்டிகள் சட்டப்பிரிவு 7A இன் கீழ் வரிவிதிப்புக்கு உள்ளாக்கப்பட வேண்டியவைகள் என்று இந்த நீதிமன்றம் வழங்கிய தீர்ப்பையும் AO மேலும் சுட்டிக்காட்டியிருக்கிறார். 6.2. 30.04.1999 தேதியிட்ட அந்த அறிவிப்புக்கு எதிர்வினையாக தனது மறுப்புகளை 27.09.1999 அன்று வரிவிதிக்கப்படுபவர் தெரிவித்திருக்கிறார். அதில் பீர் மற்றும் ஐஎம்எஃப்எல் மதுபானங்களை நிரப்புவதற்கு வாங்கப்பட்ட காலி பாட்டில்களுக்கு சட்டப்பிரிவு 7-A இன் கீழான கொள்முதல் வரிவிதிப்பு பொருந்தாது, எப்படியிருந்தாலும், SCCT வழங்கிய 09.11.98 தேதியிட்ட விளக்க அறிக்கையின் படி, வரி வருவாய்துறையை கட்டுப்படுத்தும் சட்டப்பிரிவு 28-A ஐ கருத்தில் கொள்கையில் முன்மொழியப்பட்ட இந்த கொள்முதல் வரி விதிப்பு சட்டத்திற்கு புறம்பானதும் மற்றும் நியாயமற்றதுமாகும் என்று குறிப்பிட்டிருக்கிறார். மேலும் காலி புட்டிகள் கொள்முதல் மீது கொள்முதல் வரி விதிப்பது சட்டத்துக்கு புறம்பானதும் மற்றும் நியாயமற்றதும் என்று 1986-87 லிருந்து 1988-89 வரையிலான வரிவிதிப்பு ஆண்டுகளுக்கான விசாரணை நடவடிக்கைகளின் போது மேல்முறையீட்டு துணை ஆணையர் (CT) சென்னை7 தெரிவித்த கருத்துக்களின் மீது வரிவிதிக்கப்படுபவர் தனது நம்பிக்கையை தெரிவித்திருக்கிறார். வரிவிதிக்கப்படுபவரின் கூற்றில் அடிப்படையாக விளங்குவது, கொள்முதல் செய்யப்பட்ட காலி புட்டிகள் வேறு எந்த ஒரு பொருள் தயாரிப்பிலும் நுகரப்படவோ அல்லது பயன்படுத்தப்படவோ இல்லை என்பதுதான்; பீர் அல்லது ஐஎம்எஃப்எல் மதுபான தயாரிப்பு அது புட்டிக்களில் அடைக்கப்படுவதற்கு முன்பே நிறைவு பெற்றுவிடுகிறது; பீர் அல்லது ஐஎம்எஃப்எல் மதுபான தயாரிப்புக்கள் புட்டிக்களில் அடைக்கப்படுவது தயாரிப்பு நடைமுறைகளை நிறைவு செய்வதில்லை மற்றும் பீர் மதுபானத்தை பீப்பாய்களிலும் கூட விற்பனை செய்வது ஒரு தெளிவான வணிக நடவடிக்கையாக விளங்குவதால், தயாரிக்கப்பட்டதைத் தொடர்ந்து புட்டிக்களில் பீர் மதுபானம் நிரப்பப்படும் நடவடிக்கை அதன் தயாரிப்பில் எந்த ஒரு பங்கையும் ஆற்றவில்லை என்பதை தெளிவாகத் காட்டுகிறது. 6.3. மேலே குறிப்பிட்ட 30.04.199 தேதியிட்ட AO வின் அறிக்கையின் மீது PCCT தனது இறுதி உத்திரவை பிறப்பிக்கும் முன் 09.11.1989 தேதியிட்ட விளக்க அறிக்கை அமலில் இருந்த சம்பந்தப்பட்ட காலகட்டமான 1991-92, 1993-94, 1994-95 மற்றும் 1995-96 ஆண்டுகளுக்கான வரிவிதிப்பின் போது காலி புட்டிகள் கொள்முதல் மீது வரி விதிக்கக் கூடாது என்று 27.12.200 தேதியிட்ட தனது விளக்க அறிக்கையில் தெரிவித்தது. 6.4. இருப்பினும், அப்பல்லோ சலைன் பார்மசூட்டிக்கல்ஸ் (பி) லிமிடட் // எதிர்// தமிழ்நாடு அரசு (2000) 120 STC 493 வழக்கில் தமிழ் நாடு வரிவிதிப்பு சிறப்பு தீர்ப்பாயம், சென்னை7 மேற்கொண்ட முடிவுகளை மீள்ஆய்வு செய்தPCCT அதற்கு முந்தைய விளக்க அறிக்கைகளில் குறிப்பிடப்பட்டவைகளை திருத்தியமைத்து வரிவிதிக்கப்படுபவர், பதிவு பெறாத விற்பனையாளர்களிடமிருந்து தான் தயாரிக்கும் பீர்/ஐஎம்எஃப்எல் மதுபானங்களை நிரப்புவதற்கு பயன்படுத்தும் காலி புட்டிகளை கொள்முதல் செய்வதற்கு சட்டப்பிரிவு 7-Aஇன் கீழ் வரிசெலுத்த கட்டுப்பட்டவராவார் என்று தனது 28.01.2002 தேதியிட்ட விளக்க அறிவிப்பில் குறிப்பிட்டு வழங்கியது 6.5 மேலே குறிப்பிடாவைகளைத் தவிர, 1996-97 ஆண்டுக்கான முந்தைய வரிவிதிப்பில் வரிவிதிக்கப்படுபவர் TASMAC நிறுவனத்துக்கு அளித்த ரொக்க தள்ளுபடிச் சலுகை மீது அனுமதிக்கப்பட்ட வரி விலக்கை ரத்து செய்து அந்த சொல்லப்பட்ட ரொக்க தள்ளுபடி பணச்சலுகை மீது உபரி வரி, மற்றும் முறையே 15% மற்றும் 5% விகிதத்தில் கூடுதல் உபரி வரி அத்துடன் கூடுதலாக விற்பனை வரி ஆகியவற்றை விதித்து திருத்தியமைப்பதற்கான முன்மொழிதலை AO தனது 05.02.2002 தேதியிட்ட அறிவிப்பில் அளித்தார். வரி விதிக்கப்படுபவர் 05.02.2002 தேதியிட்ட இந்த அறிவிப்பிற்கு எதிர்வினையாக எந்த ஒரு விற்பனை தொடர்பாகவும் விலையின் மீது வழங்கப்பட்ட எந்த ஒரு ரொக்க அல்லது இதர தள்ளுபடிகள் மற்றும் வாடிக்கையாளர்களால் திருப்பியனுப்பப்பட்ட பொருட்கள் தொடர்பாக திருப்பி அளிக்கப்பட்ட எந்த ஒரு தொகையும் மொத்த விற்பனையின் கணக்கில் எடுத்துக்கொள்ளப்படக்கூடாது என்று தனது 18.03.2002 தேதியிட்டு சமர்ப்பிக்கப்பட்ட கடிதத்தில் தெரிவித்தார். இது தொடர்பாக, அந்த சட்டத்தின் பிரிவு 2(iii) லிருந்து பிரிவு 2 (r) வரையிலான பிரிவுகளின் படியான விளக்கத்தின் மீது வரிவிதிக்கப்படுபவர் நம்பிக்கை தெரிவித்தார். 6.6 வரிவிதிக்கப்படுபவர் தெரிவித்த மறுப்புக்களை ஆய்வு செய்த AO அவரது 27.03.2002 தேதியிட்ட உத்திரவில் பதிவு பெறாத விற்பனையாளர்களிடமிருந்து காலி புட்டிகள் கொள்முதல் செய்த வகையில் சட்டப்பிரிவு 7A யின் கீழ் 16% என்ற விகிதத்தில் கொள்முதல் வரி மற்றும் உபரிவரி மற்றும் முறையே 15% மற்றும் 5% விகிதத்தில் கூடுதல் உபரி வரி மற்றும் அத்தோடு கூடுதலாக 2.5% விகிதத்தில் விற்பனை வரியையும், மற்றும் தண்டத்தொகையும் குறிப்பாக அந்த காலி புட்டிகள் பதிவு பெறாத விற்பனையாளர்களிடமிருந்து கொள்முதல் செய்யப்பட்டது மற்றும் பீர் மற்றும் ஐஎம்எஃப்எல் தயாரிப்புக்களை உற்பத்தி செய்வதில் மூலப்பொருளாக பயன்படுத்தியது மற்றும் அவை தனித்தனியாக விற்பனை செய்யப்படவில்லை என்றதன் அடிப்படையில் முன்மொழியப்பட்ட வரி விதிப்பை உறுதி செய்தார். AO தனது முடிவுகளுக்கு ஆதரவாக பிரீமியர் பிரீவரீஸ் //எதிர்// கேரள அரசு :(1998) 108 STC 598 என்ற வழக்கில் இந்த நீதிமன்றம் அளித்த தீர்ப்பை சார்ந்து அதன் அடிப்படையில் அப்பல்லோ சலைன் பார்மசூட்டிக்கல்ஸ் (பி) லிமிட்டட் // எதிர்// துணை வணிகவரி ஆணையர் மற்றும் மற்றவர்கள் : (2002)125 STC 500 வழக்கில் சென்னை உயர்நீதிமன்ற அமர்வு வழங்கிய தீர்ப்பையும் சார்ந்து சமர்ப்பித்திருந்தார். . 6.7 மேலும், ரொக்க தள்ளுபடி சலுகை மீது விதிக்கப்பட்ட வரி தொடர்பாக எழுப்பப்பட்ட மறுப்புக்களை ஒதுக்கித் தள்ளிய AO TASMACக்கு வழங்கப்பட்ட ரொக்கத் தள்ளுபடி சலுகையானது விலைச்சீட்டுக்கான தொகையை விரைந்து முடிவு செய்வதற்காகத்தான் அந்த வழங்கப்படுகிறது என்றும் அது வங்கிகள்/நிதி நிறுவனங்கள் ஆகியவற்றில் நடைமுறையிலுள்ள கட்டண தள்ளுபடிக்கு இணையானதுதான் என்றும் " ரொக்க தள்ளுபடி" என்ற பெயரைக் கொண்டிருந்தாலும் அது எளிதாக பணம் செலுத்துதலை பயன்படுத்தி தரகுத் தொகை பெற்றுக்கொள்ளும் ஒரு வழிதான் என்றும் அது தள்ளுபடி என்ற எல்லைக்குள் வராது மற்றும் அது கழிக்கப்படக்கூடியது அல்ல என்றும் கூறி அது அனுமதிக்கப்படுவதை மறுக்கும் முன்மொழிவை உறுதி செய்தார். 7. AO அவர்களால் மேற்கொள்ளப்பட்ட உத்திரவால் பாதிக்கப்பட்ட வரிவிதிக்கப்படுபவர் 27.03.2002 தேதியிட்ட உத்திரவை ரத்து செய்யவும் மற்றும் 09.11.1089 மற்றும் 27.12.200 தேதியிட்ட விளக்க அறிக்கைகளில் கொடுக்கப்பட்டவைகளை அமல்படுத்த AO வுக்கு உத்திரவிடக்கோரியும் O.P. எண். 476 of 2002 மூலமாக தீர்ப்பாயத்தை அணுக வரிவிதிக்கப்பட்டவர் தீர்மானித்தார். 7.1 தீர்பாயமானது தனது 26.06.2002 தேதியிட்ட உத்திரவில் O.P. எண். 476 of 2002 ஐ தள்ளுபடி செய்த அதேசமயம், சமீபத்திய 28.01.2002 தேதியிட்ட விளக்க அறிக்கை தீர்ப்பாயத்தால் மேற்கொள்ளப்பட்ட கருத்தின் அடிப்படையில் வழங்கப்பட்டது மற்றும் அது உயர்நீதிமன்றத்தால் உறுதி செய்யப்பட்டது என்பதால், இதற்கு முன்பு அளிக்கப்பட்ட விளக்க அறிக்கைகளின் அடிப்படையில் AO அவர்களின் நடவடிக்கைகள் குறித்து கேள்வி எழுப்பும் உரிமை வரிவிதிக்கப்படுபவருக்கு இல்லை என்ற கருத்தை தெரிவித்தது. மேலும் காலிப்புட்டிகள் மீது விதிக்கப்படும் வரி பீப்பாய்கள் மற்றும் குடுவைகளுக்கும் நீட்டிக்கக் கூடியது என்றும் மற்றும் பீப்பாய்கள் மற்றும் குடுவைகளை விலக்கிவைத்துவிட்டு புட்டிகள் மீதான வரிவிதிப்புக்களை மட்டும் ஒதுக்கி வைக்கவோ அல்லது திரும்பப்பெறவோ முடியாது என்றும் கருத்து தெரிவித்தது. மேலும் அஸ்ஸோஸியேட்டட் பார்மசூட்டிக்கல் இண்டஸ்ட்ரீஸ் // எதிராக// தமிழ்நாடு அரசு : (1986) 63 STC 316 வழக்கில் வழங்கப்பட உயர்நீதிமன்ற அதிகார வரப்பிற்குள்ளான தீர்ப்பு இதற்கு பொருந்தாது என்றும் அது சட்டப் பிரிவு 7- A(1) a யானது 1986 தமிழ் நாடு சட்ட எண் 78 மூலம் திருத்தப்பட்டு 01.01.1987 முதல் அமலுக்கு வந்ததற்கு முன் வழங்கப்பட்டது என்றும் தீர்ப்பாயம் மேலும் கருத்துத்தெரிவித்திருந்தது. திருத்தத்தில் "பயன்பாடு" என்ற வார்த்தையை உள்ளீடு செய்ததன் மூலம் குறிப்பிட்ட அந்த சட்டப்பிரிவு அளிக்கும் அர்த்தம் அதற்கு முன்பு அது அளித்த அர்த்தத்திலிருந்து மாறுபடுகிறது. ஆகவே, 28.01.2002 தேதியிட்ட விளக்க அறிக்கைக்கு இணங்க நடவடிக்கைகளை மேற்கொண்ட அதே சமயம், 27.03.2002 தேதியிட்ட உத்திரவில் தலையிட தீர்பாயம் மறுத்துவிட்டது. 8. 26.06.2002 தேதியிட்ட தீர்ப்பாயத்தின் உத்திரவால் மனக்குறையுற்ற வரிவிதிக்கப்பட்டவர் W.P.எண். 25081 of 20012 கொண்ட தீர்ப்பாணை மனுவை மெட்ராஸ் உயர்நீதிமன்றத்தில் தாக்கல் செய்தார். அதில் கேள்விக்குட்படுத்தப்பட்ட நடவடிக்கைகளை ரத்துசெய்யவும் மற்றும் 09.11.1989 மற்றும் 27.12.200 தேதியிட்ட விளக்க அறிக்கை/சுற்றறிக்கைகளை அமல்படுத்த புதிய உத்திரவை பிறப்பிக்குமாறு AO அவர்களுக்கு உத்திரவிட வேண்டி ஆவணக்கட்டுகளை அனுப்புகை உயர்வழக்கு தீர்ப்பாணை ஒன்றை (certiorarified mandamus) வழங்குமாறு கோரியிருந்தார். வரிவிதிக்கப்படுபவரால், தாக்கல் செய்யப்பட அந்த தீர்ப்பாணை மனு உயர்நீதிமன்றத்தால் கருத்தில் கொள்ளப்பட்டு அதன் 10.09.2004 தேதியிட்ட மறுத்துரைக்கப்பட்ட ஆணை மூலமாக தீர்த்து வைக்கப்பட்டது. 8.1. உயர்நீதிமன்றம் 10.09.2004 தேதியிட்ட அதன் மறுத்துரைக்கப்பட்ட ஆணையில் பின்வரும் மூன்று கேள்விகளை தனது கருத்தில் எடுத்துக்கொண்டது. i. "பீர் மற்றும் ஐஎம்எஃப்எல் மதுபான உற்பத்தி வணிகத்தில் ஈடுபட்டுவரும் மனுதாரரின் நிறுவனம் அவர்களால் உற்பத்தி செய்யப்பட பீர் மற்றும் ஐஎம்எஃப்எல் மதுபானங்களை புட்டிக்களில் நிரப்புவதற்காக பதிவு பெறாத விற்பனையாளர்களிடமிருந்து கொள்முதல் சீட்டு மூலம் காலி புட்டிகளை விற்பனைக் கொள்முதல் செய்த ரூ. 24,78,20,465 என்ற அளவிலான தொகை தமிழ்நாடு பொது விற்பனை வரி சட்டம்(சுருக்கமாக "அந்தச் சட்டம்" ) பிரிவு 7-Aயின் கீழ் கொள்முதல் வரிவிதிப்புக்கு உட்படுத்தக் கூடியதா? ii. 9.11.1989 தேதியிட்ட விளக்க அறிக்கை மற்றும் அந்தச் சட்டத்தின் பிரிவு 28 Aயை கருத்தில் கொண்டு சென்னை சிறப்பு வணிக வரி ஆணையர் மனுதாரரின் நிறுவனத்திற்கு ஆதரவாக 27.12.200 தேதியிட்ட விளக்கள் ஆகியவை அளிக்கப்பட்டிருந்த போதிலும் மனுதாரரின் நிறுவனம் காலிபுட்டிகள் வாங்குவதற்காக விற்பனைக் கொள்முதல் செய்த ரூ. 24,78,20,465 என்ற அளவிலான தொகை மீது அந்தச் சட்டத்தின் பிரிவு 7-Aயின் கீழ் கொள்முதல் வரிவிதிக்கப்பட்டதா? மற்றும் iii. அந்தச்சட்டத்தின் 2(iii) பிரிவிலிருந்து 2(r) வரியிலான பிரிவுகளில் கொடுக்கப்பட்ட விளக்கங்களைக் கருத்தில் கொள்ளும் போது, TASMAC நிறுவனத்துக்கு மனுதாரரின் நிறுவனம் விலை மீது வழங்கிய ரொக்கத் தள்ளுபடி தொகை வரிவிதிப்புக்கு உள்ளாக்கப்படக்கூடியதா?" 8.2. எதிராளிகளின் கூற்றுக்களை கருத்தில் கொண்டு, வழக்கின் பொருள்குறித்த தீர்ப்பு வழிச்சட்டத்தை விரிவாக ஆராய்ந்த பின்னர் இந்த உயர்நீதிமன்றம், ப்ரீமியர் பிரீவரீஸ் (முன்னுள்ளவாறு) மற்றும் உதவி ஆணையர் (இண்டெல்லிஜென்ஸ்) // எதிர்// நந்தனம் கன்ஸ்ட்ரக்ஷன் கோ.: (1999) 115 STC 427 இல் இந்த நீதிமன்றம் வகுத்து நிறுவிய சட்டங்களை செயல்படுத்தும் விதமாகவும் மற்றும் திருத்தியமைக்கப்பட்ட அந்தச் சட்டப்பிரிவு 7-A மற்றும் தமிழ்நாடு அரசு // எதிர்// எம்.கே.கந்தசாமி மற்றும் மற்றவர்கள்: (1975) 36 STC 191 என்ற வழக்கில் இந்த வழங்கல்களின் குறிக்கோள்களையும் பார்வையில் கொண்டு அதாவது சரக்கு கொள்முதல் தொடர்பாக வரி விடுபட்டுப்போவது மற்றும் வரி ஏய்ப்பு செய்வது ஆகியவற்றை தடுப்பதற்கு காலிபுட்டிக்களின் விற்பனைக் கொள்முதல் தொகை இந்த சட்டத்தின் பிரிவு 7-Aயின் கீழ் வரி விதிப்புக்குள் வராது என்ற வரிவிதிக்கப்படுபவரின் வாதத்தை நிராகரித்து உயர்நீதிமன்றம் பின்வருமாறு தனது கருத்தை தெரிவித்தது: "7.6. ஆகவே உச்ச நீதிமன்றம் (i) ப்ரீமியர் பிரீவரீஸ் //எதிர்// கேரள அரசூ (1998) 108 STC 598; மற்றும் (ii) உதவி ஆணையர் (இண்டலிஜென்ஸ்) //எதிர்// நந்தனம் கன்ஸ்ட்ரக்ஷன் கோ. (1999) 115 STC 427 வகுத்த சட்டங்களை செயற்படுத்தி , ஆபோல்லோ சலைன் பார்மசூடிக்கல்ஸ் (பி) லிட். //எதிர்// துணை வணிகவரி ஆணையர் & மற்றவர் (2002) 125 STC 500 இல் இந்த இந்த நீதிமன்றம் பின்பற்றியதை தொடர்ந்து மற்றும் திருத்தப்பட்ட அந்த சட்டத்தின் பிரிவு 7 A யின் நோக்கம் தமிழ்நாடு அரசு //எதிர்// எம்.கே. கந்தசாமி மற்றும் மற்றவர்கள் (1975) 36 STCயில் கடைப்பிடிக்கப்பட்டதை மனதில் கொண்டு, பொருள் கொள்முதல் தொடர்பாக வரி விடுபட்டுப்போவது மற்றும் வரி ஏய்ப்பு செய்வது ஆகியவற்றை தடுப்பதற்கு பதிவு பெறாத விற்பனையாளர்களிடமிருந்து கொள்முதல் சிட்டையின் கீழ் காலிபுட்டிக்களின் விற்பனைக் கொள்முதல் செய்தது குறித்த திரு.சி.நடராஜன் அவர்களின் கருத்தான, . பதிவு பெறாத விற்பனையாளர்களிடமிருந்து கொள்முதல் சிட்டையின் கீழ் காலிபுட்டிக்களின் விற்பனைக் கொள்முதல் செய்வது இந்த சட்டத்தின் பிரிவு 7-Aயின் கீழ் வரி விதிப்புக்குள் வராது என்ற வாதத்தை நாங்கள் நிராகரிக்கிறோம்” 8.3. இருப்பினும், இரண்டாவது கேள்வியைப் பொறுத்தவரையில் உயர்நீதிமன்றம், மற்றவற்றுக்கிடையில், 16.11.1997 முதல் அமலுக்கு வந்த திருத்தம் செய்த அந்த சட்டத்தின் பிரிவு 28A இன் அடிப்படையில் சட்டபூர்வமான அதிகாரத்தை 27.12.2000 தேதியிட்ட விளக்க அறிக்கை பெற்றுள்ளது என்று கருதியது. மேலும் கலெக்டர் ஆஃப்சென்ட்ரல் எக்சைஸ் வதோதரா // எதிர்// தீரன் கெமிக்கல்ஸ் இண்டஸ்டிட்ரீஸ்: (200) 126 STC 122 என்ற வழக்கில் இந்த நீதிமன்றத்தின் அமர்வு அளித்த தீர்ப்பு உட்பட பல்வேறு தீர்ப்புக்களை ஆதாரமாகக் கொண்டு 09.11.1989 தேதியிட்ட விளக்க அறிக்கை செயல்படத்தக்க ஒன்றாக இருந்தாலும் வரிவிதிக்கப்படுபவருக்கு விளக்க அறிக்கையின் அடிப்படையில் கொடுத்துவந்த சலுகைகள் 28.01.2002 முதல் இனிவரும் தேதியிலிருந்து விலக்கிக்கொள்ளப்பட்டதுவரை அது அதிகாரிகளையும் கட்டுப்படுத்துவதாக இருந்தது மற்றும் அந்த சட்டத்தின் பிரிவு 7-Aயின் கீழ் 9.11.1989 மற்றும் 27.12.2000 தேதியிட்ட அறிக்கைகளின் அடிப்படையில் வழங்கப்பட்ட 1996-97 ஆண்டுக்கான கொள்முதல் வரி பயன்களை வரிவருவாய் துறை மறுக்கமுடியாது. உயர்நீதிமன்றம் இந்தக் கேள்விக்கான பதிலை வரிவிதிக்கப்படுபவருக்கு சாதகமாக பின்வருமாறு அளித்தது: “8.6.1 ஆகவே 9.11.1989 தேதியிட்ட விளக்க அறிக்கை செயல்படத்தக்கதாக இருந்தாலும் வரிவிதிக்கப்படுபவருக்கு விளக்க அறிக்கையின் அடிப்படையில் கொடுத்துவந்த சலுகைகள் தேதியிலிருந்து விலக்கிக்கொள்ளப்பட்டதுவரை அது அதிகாரிகளையும் கட்டுப்படுத்துவதாக இருந்தது, அது பின்வரும் தேதியிலிருந்துதான் செயல்படுத்தப்பட முடியும் அதாவது இந்த வழக்கைப் பொருத்தவரை 28.1.2002லிருந்துதான் செயல்படுத்தப்படமுடியும். மற்றும் வரிவருவாய்த்துறையால் மறுத்துரைக்கப்பட்ட வரிவிதிப்பு 1996-97 ஆண்டைப் பொறுத்த வரையில் அந்த சட்டத்தின் பிரிவு 7-Aயின் கீழ் 9.11.1989 மற்றும் 27.12.2000 தேதியிட்ட அறிக்கைகளின் அடிப்படையிலான கொள்முதல் வரி பயன்களை வரிவருவாய் துறை மறுக்கமுடியாது. 8.7. இந்த அனைத்து காரணங்களை முன்னிட்டு, பதிவுபெறாத விற்பனையாளர்களிடமிருந்து கொள்முதல் சீட்டு மூலம் கொள்முதல் செய்யப்பட்டதை பொறுத்த வரையில் அந்த சட்டப்பிரிவு 7-Aயின் கீழ் வரிவிதிக்கப்படலாம் என்றாலும் 9.11.1989 மற்றும் 27.12 200 தேதியிட்ட விளக்க அறிக்கையில் வழங்கப்பட பயன்களை பின்னாளில் 28.1.2002 தேதியிட்ட விளக்க அறிக்கை மூலம் திரும்பப்பெற்றுக்கொள்ளப்படும் காலம் வரையில் அந்த பயன்களை அடையும் உரிமை வரிவிதிக்கப்படுபவருக்கு இருக்கிறது என்று நாங்கள் நம்புகிறோம். .ஆகவே, பதிவு பெறாத விற்பனையாளர்களிடமிருந்து காலி புட்டிகளை விற்பனைக் கொள்முதல் செய்த தொகைமேல் அந்தச் சட்ட விதிப்பிரிவு 7-Aயின் கீழ் மறுத்துரைக்கப்பட்ட கொள்முதல் வரியை விதித்தது சட்டத்துக்குப் புறம்பானது.” 8.4 இறுதியாக, மூன்றாவது கேள்வியைப் பொறுத்தவரையில் நெய்வேலி லிக்நைட் கார்போரேஷன் லிட். //எதிர்// வணிக வரி அதிகாரி, கடலூர் மற்றும் ஒருவர் : (2001) 124 STC 586 என்ற வழக்கில் இந்த நீதிமன்றத்தின் அமர்வு அளித்த தீர்ப்பு உட்பட பல்வேறு தீர்ப்புக்களை ஆதாரமாகக் கொண்டு, அந்த சட்டத்தின் பிரிவுகள் 2(iii) லிருந்து 2(r)வரையிலான பிரிவுகளில் விளக்கப்பட்டுள்ளபடி விற்கப்பட்ட எந்த ஒரு பொருளின் மீதும் விலையில் வழங்கப்பட்ட எந்த ஒரு ரொக்க அல்லது இதர தள்ளுபடிகள் வரிவிதிப்புக்காக மொத்த விற்பனையின் கணக்கில் எடுத்துக்கொள்ளப்படக்கூடாது என்ற கருத்தை கொண்டது. அதன்படியே இந்தக் கேள்விக்கான பதிலும் வரிவிதிப்பவருக்கு சாதகமாகவும் வரிவருவாய்த்துறைக்கு எதிராகவும் பின்வருமாறு அளிக்கப்பட்டது:- “9.4. நெய்வேலி லிக்நைட் கார்போரேஷன் லிட். //எதிர்// வணிக வரி அதிகாரி, கடலூர் மற்றும் ஒருவர் : (2001) 124 STC 586 என்ற வழக்கில் விற்பனையாளரால் அது ரொக்கம் அல்லது வேறுவகைகளின் மூலமாக மேற்கொள்ளப்பட்டதாக இருந்தாலும் அந்த விற்பனையை பொறுத்தவரையில், அந்த விற்பனைத் தொகை மட்டுமே அந்த விற்பனையாளரின் மொத்தவிற்பனைத் தொகையின் ஒரு பகுதியாக கருதப்படும் என்று உறுதி செய்யப்பட்டது 9.5 “மேற்கண்டவாறு பார்வையிலுள்ள முடிவுகளிலிருந்து தெளிவாக விளக்கப்பட்டுள்ள சட்டத்தின் மூலம் அந்த சட்டத்தின் பிரிவுகள் 2(iii) லிருந்து 2(r)வரையிலான பிரிவுகளில் விளக்கப்பட்டுள்ளவைகளைக் கருத்தில் கொண்டு விற்பனை செய்யப்பட பொருளின் விலையின் மீது வழங்கப்பட்ட ரொக்க அல்லது இதர தள்ளுபடிகள் வரிவிதிப்பிற்கான மொத்தவிற்பனை தொகையில் சேர்த்துக்கொள்ளக்கூடாது என்பதில் நாங்கள் நம்பிக்கை கொண்டுள்ளோம்.” 8.5 ஆகவே, உயர்நீதிமன்றம், குறிப்பாக மேலே குறிப்பிட்ட கேள்வி எண்கள் (ii) மற்றும் (iii) ஆகியவைகளுக்கு அது அளித்த பதில்கள் மூலம் வரிவிதிக்கப்பட்டவர் தாக்கல் செய்த நீதிப்பேராணை மனுவை அனுமதித்தது. 9. So I started dealing. I got really good at it, too, and I made a lot of money. My life was even threatened several times by some of the people I was involved with. And my parents had no idea. Throughout that whole time, I was really, really down. I felt like no one really understood me. Marijuana was the only thing that got me out of my head a bit and made me happy. Sometimes, when I got really depressed, I would load one bullet into a gun, and pull the trigger while pointing it at my head. Then one night, January 3, 2015, I got a lot of marijuana. But I was playing my music too loud, so my mom came in. She took in the whole scene, and freaked out. She thought the marijuana was all my grandpa’s. It really scared me. After that, I started getting help to deal with my depression. I went on anti-depressants and started seeing a counselor. I haven’t smoked marijuana since that night in January, which has definitely helped things. Even though I still have anger issues, I’m able to deal with my emotions through physical activity. I worked as a General Manger in a Industrial Textile manufacturing company,and took 'translation' as a career
after my retirement. I am a Tamil Translator. And translated articles,
