Solicitor Gnl of Spain responds to preliminary reference procedure sought by an association and backed by the Supreme Court of Spain alleging that a Spanish law is incompatible with EU law.
NOTE: The preliminary ruling "cuestión prejudicial" has NOT yet been issued by the CJEU. The process is in the preliminary reference procedure phase, with the Spanish State presenting its arguments before the CJEU:
"El Reino de España considera que el modelo persona jurídica actualmente regulado en el artículo 25 de la LPI actualmente vigente no es contrario a la Directiva 2001/29, por cuanto no se vulnera ningún principio ni disposición expresa del Derecho de la Unión, y responde a la amplía libertad de configuración que este Derecho de la Unión atribuye a los legisladores nacionales. No se advierte en la Directiva 2001/29 disposición alguna (ni tampoco se cita en **EL AUTO DE planteamiento de la cuestión prejudicial**), que sea contradicha o vulnerada por el modelo español de persona jurídica.

Hmm... not sure they are ECJ proceedings exactly. This is the Spanish Government's response to the Spanish Supreme Court's endorsement of a preliminary reference procedure before the CJEU; the Government's "observations" refuting the validity of the complaint. Evidently, the observations have not been translated into English, or, if they have, this client is wasting a lot of money because I am translating them. IATE offers no hconvincing translation.

Just a thought If these are ECJ proceedings will there not be an official English translation you can go to?

The court's decision regarding/asking the preliminary question

In Spain, an "auto" is an actual court decision, but one that addresses an incidental part of the process, not the final ruling. In this case the court has decided to submit a preliminary question to the CJEU and the formal document the court issues to do so is an "auto".

I do not know if there is a similar distinction between types of court decisions in the court processes in English-speaking countries, so I am not entirely sure that "decision" is the right translation, but I hope the explanation helps. For reference, article 206.1.2 of the Spanish law of Civil Proceedings defines what an "auto" is. Link to the law below.

the initial ruling relating to the issue that must be resolved before filing suit

the Order which refers the Case for preliminary ruling

'The 2001/29 Directive has no provision, while neither there is one found or quoted in the Order which refers the Case for preliminary ruling, which is contradicted or infringed by the Spanish model of a legal person.'
Example sentence:
