This "be and the same" expression has confused me. I will appreciate if you help me. It is referring to a dissolution of marriage.

The phrase start as follows: ....This court drcrees that the marriage solemnised on the 18th day of November 19xx at the registra's office at xxxxx between the above named petitioner and respondent BE AND THE SAME is hereby .......

Καλημέρα! Συμφωνώ με τον Dave. Αν υπήρχαν τα κόμματα, δεν θα υπήρχε κανένα απολύτως πρόβλημα. Άλλωστε, πρόκειται για standard phrasing με το //and the same is hereby// πάντα μέσα σε κόμματα > π.χ. ... shall be, and the same is hereby, dissolved...

How does the phrase start? If there is something like "I declare that...." before the phrase you've written, then the meaning is something like:

I declare that the marriage between the petitioner and respondent BE dissolved, AND THE SAME marriage is dissolved by this document

ie old-fashioned (subjunctive?) use of 'be', and strange word order to avoid the repetition of 'dissolved'
