I was told by Mr. XXX that XXXX had received substantial tax planning advice before setting up the so called “back-to-back” transactions with multiple banks.
From conversation with Mr. XXX, XXX and Mr.XXXX, I do not believe the back-to-backs were set up to conduct tax fraud at the outset.

Pelo contexto, ele está querendo testemunhar em favor do réu alegando que a fraude pode não ter sido intencional. A depender do nível de formalidade esperado, "de má fé" pode ser uma boa alternativa.

Quer dizer que a testemunha considera que motivo da criação dos back-to-back não era fraudulento, (embora não descurando a hipotese destes ter tido uso fraudulento subsequente).
